OFFICIAL NOTICE AND AGENDA

The Board of Supervisors of the Town of Maine will hold a special meeting on Friday, September 19, 2008 at 7:00 a.m. at the Town of Maine Town Hall.

Agenda

1. Call meeting to order – Betty Hoenisch, Chairperson
2. Discussion with 3m regarding possible reconstruction of N. 4th Avenue and possible funding for that project.
3. Discussion and possible action on a Road Maintenance Agreement for N. 4th Avenue.
4. Discussion and possible action regarding 3M’s request for an increase to 90,000 lb road weight limits on N. Fourth Avenue.
5. Adjournment.

Special Board of Supervisor Meeting


Chair Hoenisch called the meeting to order at 7:00 a.m.

Present were Chair Hoenisch, Supervisor Tad Schult, Attorney Frokjer and Taylor Austin, Jeff Osterhuis and John Edwards from 3M. Supervisor Shore was absent due to a previsously planned vacation.

Chair Hoenisch stated that the special meeting had been scheduled to review Tetra Tech’s final report on N. Fourth Avenue.

Chair Hoenisch distributed copies of Tetra Tech’s report.

Attorney Frokjer explained that per Tetra Tech the 3M trucks are doing 95 percent of the damage on N. 4th Avenue and local traffic is doing 5 percent damage. He explained that because some trucks are hauling loaded both ways, that the Town felt it would be fair to request a 90 percent cost sharing from 3M and the Town would pay 10 percent of reconstruction costs for N. 4th Avenue.

Attorney Frokjer said that it makes sense for 3M to contribute toward the reconstruction because a new road would save on truck maintenance, workers compensation claims and safety for residents walking and biking.

John Edwards stated that he has ridden with 3M drivers and felt there is a problem with visibility due to hills. He expressed his concerns about their driver’s ability to stop quickly due to the 80,000 lbs they haul. Mr. Edwards said that 3M is requesting a year extension for the new 90,000 lb weight restriction and asked how they could make the road maintenance agreement logistically happen.

Mr. Edwards talked about his meetings with Chair Hoenisch, about the reconstruction project and different ways to possibly fund it. Both agree that part of the road maintenance fee should be passed on to the non 3M construction trucks that use N. 4th Avenue to haul rock, dust, sand, cement and blacktop from 3M’s property. Mr. Edwards also explained that safety is a big concern for him and would like 3M to participate in a biking / walking path.

Jeff Osterhuis asked how the Town determined the traffic counts. Attorney Frokjer explained that Chair Hoenisch’s husband had video recorded several days’ traffic. The video was put on DVD’s and then watched to calculate the traffic counts. He said the DVD’s would make the case very defendable in court.

Attorney Frokjer explained the additional research done by Tetra Tech on the different truck axle patterns, the number of axles and how axle spacing affect the impact and or damage that is done to a road.

Chair Hoenisch explained that Mr. Walters used ASHTO software which is a world wide company and that enabled him to calculate the percentage of damage on N. 4th Avenue from truck traffic verses car traffic.

Discussion followed on the report and type of asphalt surface that Tetra Tech’s engineer recommended. Supervisor Schult explained that the current road surface needs to be milled off, a four inch layer of large rock asphalt applied, followed with a two inch E-10 highway super pavement layer.

The proposed cost for the project was discussed. Attorney Frokjer explained that a 24 foot wide road was approximately $370,000.00. He said a 24 foot wide road would allow for a 2 foot designated area for biking and walking. Based on the per foot calculation of a 24 foot road, a road 22 feet wide would cost approximately $329,000.00 with $40,000.00 left to create a separate bike / pedestrian path.

Mr. Edwards stated that he felt a 24 foot road top would not allow a safe amount of room for walkers and bikers. Discussion followed on a 22 foot wide road with a separate biking / pedestrian path on the east side of N. 4th Avenue.

Mr. Austin made comments on the 80,000 lb verses 90,000 lb weight restriction impacts on N. 4th Avenue. Attorney Frokjer explained Tetra Tech’s impact study which shows that a truck does three thousand times more damage in a day verses a car. It would take approximately 750,000 cars a day on N. Fourth Avenue to equal the damage done by 3M’s truck traffic.

Mr. Edwards explained that they need to go back and see what they can work out with the multiple layers of management. He said that 3M is asking for a year extension to the new D.O.T.’s 90,000 lb weight restriction, so then they can purchase new equipment. Attorney Frokjer asked what is the window of time you are asking for? Mr. Edwards said they would like the Town to allow the 90,000 lbs until May 27, 2009 which would match 3M’s agreement with Wausau.

Supervisor Schult explained that if the Town extends 3M’s weight restrictions to 90,000 lbs, then we do not want to let the agreement slide. He said that if 3M does not come across with a suitable offer, the Town Board will then not extend the 90,000
lbs. weight limits road agreement and then will not repair N. 4th Avenue. Mr. Schult also explained that the Town Board needs to get funding into the 2009 budget if we want to reconstruct N. 4th Avenue next year. Supervisor Schult said that funding for 2009 will be decided at the November Budget Public Hearing.

Mr. Austin said it is unfair to ask 3M to get an agreement done in a month when it took the Town several months to get Tetra Tech’s report to them. Attorney Frokjer said the Town wants to be fair because it took us longer than originally predicted to do our research. Chair Hoenisch explained that they received several different opinions from road contractors regarding the reasons for N. 4th Avenue’s pavement condition so the Town Board decided to have engineering done to get answers. Supervisor Schult said it was important to test the base and get construction specifications, so we can reconstruct the road correctly, to make it last longer.

The next item on the agenda was discussion and possible action on a Maintenance Agreement for N. Fourth Avenue. Attorney Frokjer asked what time frame they need to present the Town’s proposal to 3M Corporate. The Town wants to be fair to 3M and to its residents. Mr. Edwards talked about the issues they need to work through. He felt they could get back to the Town in approximately a month. Chair Hoenisch said it is important to do the maintenance agreement properly so it is set up correctly for the future. Attorney Frokjer said that this agreement would allow 3M to allocate funding for future reconstruction in 15 to 20 years. Supervisor Schult explained that because this Town Board has worked so hard on this agreement, it would be great to finalize the agreement by March 2009. In April 2009 there are elections and 3M may be working with a new Town Board and then who knows what could happen. This item was tabled until we hear from 3M.

Next item on the agenda was discussion and possible action regarding 3M’s request for an increase to 90,000 lb road weight limits on N. Fourth Avenue. Supervisor Schult made a motion to extend the time requirement for completion of a road maintenance agreement with 3M, acceptable to the Town until May 27, 2009, which is in line with the City of Wausau’s 90,000 lb weight limit extension, seconded by Chair Hoenisch. Motion carried.


Supervisor Schult made a motion to adjourn at 8:55 a.m., seconded by Chair Hoenisch. Motion carried.
