The Regular Meeting of the Board of Supervisors for the Town of Maine was held at 6:00 p.m. on September 12, 2005 in the Town Hall, 6111 North 44th Avenue, Wausau, WI 54401.
Agenda for this meeting was posted on September 9, 2005 at the Chapter Two Restaurant, Northside Citgo, Richard’s Supper Club, Schmidt’s Bar and the Town Hall.
Present were Chair Betty Hoenisch, Supervisors Dennis Wanke and Marty Zernicke, Clerk, Kimberly Freund, Treasurer, Marilyn Grunenwald Attorney Frokjer and community members.
Minutes:
Chair Hoenisch called the Town of Supervisors meeting to order at 6: 14 p.m.
Item 2: Dick Moscher and Cory Tomczyk of IROW gave a presentation of the recycling and garbage program. He stated that the cost of fuel is posing a problem with the cost of garbage pick up. Mr. Tomczyk asked if there was any room for negations to increase the contract price at this time to make up the difference for the increase in fuel.
Chair Hoenisch stated that our current contract thru 2008 includes the consumer price index increase up to 3% per year. Mr. Tomczyk that 3% will not be sufficient to cover the rising fuel costs. Our contract is $8.42 per household with recycling because the entire Town of Maine is being serviced by IROW. Mr. Moscher stated that the Town of Stettin resident’s pay $14.50 per month for garbage without recycling with IROW. The Board discussed what increase IROW would need to support a profit so they can continue garbage pick up with the Town of Maine. The Board requested IROW to attend the November 14, 2005 Board of Supervisors meeting at 6:30 p.m. to possibly amend the contract.
Item 3: Steve Steinke presented floor scrubbers for the Town Hall. He explained the types of machines and the cost of the machines. Mr. Steinke also presented the Town Board with a quote for refinishing the Town Hall floor at an approximate cost of $1,164.00. This quote included cleaning and stripping the floor, two coats of sealer, four coats of finish and deep scrubbing the bathroom floors. Mr. Steinke stated that the floor was never sealed properly if the Town does not address this issue the floor will be ruined within a couple of years.
Accounts payable were reviewed.
Chair Hoenisch adjourned the Board Of Supervisors meeting at 7:33 p.m. Supervisor Zernicke made that motion, seconded by Supervisor Wanke. Motion carried.
Chair Hoenisch called the public hearing to order at 7:34 p.m.
Discussion from the residents of the Town commenced in regards to Jenny Blahnik purchasing the Donald McMurtrie property and having the zoning changed at 3500 Falcon Drive from RR-rural residential to BP-General Business Park.
The Plan Commission had made a recommendation that the Town Board approve the petition; however they requested another public hearing tonight so the Board could ask further questions.
All residents within 100 feet from the McMurtrie property voiced their opinion in objection to the zoning change at this time.
John Ohrmundt requested that this comment be submitted into the minutes: The building that he owns on the corner of Hwy. K and Falcon Drive will not ever become manufacturing again.
Chair Hoenisch adjourned the public hearing at 8:49 p.m.
Chair Hoenisch reconvened the Board of Supervisors at 8:50 p.m.
The pledge of allegiance was recited.
Chair Hoenisch asked for a motion for approval of accounts payable, Supervisor Zernicke made that motion, seconded by Supervisor Wanke. Motion carried.
Our new Town’s Attorney, Randy Frokjer, was introduced. He is from Ament, Wulf, Frokjer and Hersil, S. C., 200 N. Center Street, Merrill, WI
Chair Hoenisch requested approval of the past month’s minutes. Supervisor Wanke made a motion to approve the August 8, 2005, August 15, 2005, August 29, 2005 and September 7, 2005 minutes, seconded by Supervisor Zernicke, Motion carried.
Chairperson’s Report:
A. At the August 15, 2005 Special Meeting the Supervisors stopped at the Courtion Property and requested a cleanup. Mr. Courtion would like an accessory building and that issue will be discussed with the Plan Commission the future. Chair Hoenisch also received complaints of dogs barking and stray cats at the property. Chair Hoenisch did call on the owners at 9:30 p.m. on Thursday, September 8, 2005 as neighboring residents were unable to sleep due to the dog disturbances. The owner of the pets said they are going to cooperate.
B. The Century Excavating will have extended cleanup until November 30, 2005. They would like to zoned B-3 or M-1 in the future.
C. The Board of Supervisors had a special closed meeting on August 29, 2005 to try to settle the Wanke case out of court. The Town at this time has $12,000 invested in the Wanke Case. It is the Board’s hope to settle this case out of court and get the matter resolved. Upon investigation by our new legal council it has been realized that the Town has not followed it’s own zoning ordinances in the past.
D. Road report: Bay Shore Drive, Dover and Excel received a double seal coat to preserve the life of these roads for five to 10 years. Decator Drive from County Road K to Merrill Avenue was also seal coated.
E. On September 7, 2005 Supervisor Zernicke and Chair Hoenisch traveled some roads in the Town with Matt from American Asphalt to obtain advice regarding possible solutions to repair those roads. Supervisor Wanke was out town that day.
F. The Board also traveled the Fitzke and Lonsdorf roads with Matt from American Asphalt. Matt offered advice on the cul de sacs, ditches and road base that needs to be addressed on these roads before the Town accepts those roads.
G. The road workers have been watering 28th Avenue and Keller Drive with the Fire Department truck to alleviate some of the dust problems due to the logging truck traffic and drought. Granite has also been incorporated into the crushed rock that was put on those roads the past two years to correct the wash boarding problems.
H. Boot, Overlook, Deer Brook, 14th Avenue north of Decator, 20th Avenue north of Rainbow, 28th Avenue north from Maine to Naugart, 36th and 44th Avenue south of Hwy. U, N. 14th Avenue, Prehn and Timber received granite.
Supervisor Wanke stated that the work done on 28th Avenue south of Rainbow is done correctly, this is a new subdivision road construction project. Supervisor Wanke stated that he inspected two other road construction projects and they do not come close to Town specifications. Attorney Frokjer stated that if there is defective work done on roads it should be at the expense of the contractors. Supervisor Wanke said the repairs were made by the contractors at no charge.
Supervisor Zernicke explained his conversation with the Wausau Fire Department in regards to fire numbers for residences. There is not any money in our budget to supply fire numbers for residents. He will take over where Supervisor Grunenwald left off. Chair Hoenisch asked if he could investigate different forms of address signs and report back to the Board. Supervisor Zernicke said yes.
Treasurer’s Report:
The Town Money Market has a balance of $150,533.16
The Town Checking has a balance of $2,900.32
The Town Garbage/Recycling Fund has a balance of $30,139.53
The Fire Dept. Money market has a balance of $11,743.38
The Fire Dept. Checking has a balance of $2,405.20
Supervisor Wanke made a motion to accept the Treasurer’s report, seconded by Supervisor Wanke, motion carried.
Zoning Administrator’s Report: Bob Christenson stated that there were four zoning permits issued-three new homes and one garage. There were 28 building permits issued to date.
Other Business:
Supervisor Wanke asked questions of the residents in regards to the rezoning of the McMurtrie property. All residents within the 100 feet of the McMurtrie property voiced their opinions that they are not in favor of the zoning change from RR to BP. The Supervisors requested advice from Attorney Frokjer. He stated to the Supervisors that this is a political decision that has to be made by you, the Board.
Attorney Frokjer stated that some towns have more influence from the attorney but his belief is that the Town should make their own decisions.
He envisions his role as our Town Attorney to make sure the legal process is followed correctly. He feels the policy making should be done by the Town Board not from one source. Attorney Frokjer stated that the long term solution for the McMurtrie property would be to allow it to be rezoned to Business Park at this time when the neighbors can have control of the choice of type of business that would be allowed in.
Steve Zahn from the Plan Commission commented that he was for the rezoning as long as the residents were in favor. After great debate the supervisors made their decision.
Supervisor Zernicke made a motion to deny the zoning petition request, seconded by Supervisor Wanke, motion carried.
The Carazalla Road Agreement needs to be amended to allow for zoning and building permits for lot 11. Supervisor Zernicke made a motion to accept the agreement, seconded by Supervisor Wanke. Motion carried.
The Plan Commission recommended that a committee be formed to assist with the zoning ordinance review and possible changes. This committee will report back to the Plan Commission with the changes. On this volunteer committee will be Deb Klopp, Tom Elias, Greg Janicek, Clark Anklam, Wes Schopke, to date. Attorney Frokjer stated that some of the ordinances need to be changed/corrected to help with future zoning issues. Supervisor Wanke made a motion to have this committee formed, seconded by Supervisor Zernicke. Motion carried.
Burnell Utecht explained that the VFW would like to have a Veterans Memorial installed on the Town of Maine Property. Supervisor Wanke stated that it would be an honor to have a memorial on the Town property. Supervisor Zernicke made a motion to accept this opportunity, seconded by Supervisor Wanke. Motion carried.
Open discussion from the residents: John Ohrmundt stated that putting $12,000 into number markers is a waste of money; residents can put reflective numbers on their mailboxes instead. He also stated that each emergency vehicle has maps with every residence on it.
Supervisor Zernicke made a motion to adjourn the meeting, seconded by Supervisor Wanke. Motion carried.
