Special Board Meeting
A Special Meeting was held at the Town of Maine Town Hall on Monday, October 1, 2007 at 7:00 p.m. regarding the Erdman property road access.
Chairperson Hoenisch called the Special Board of Supervisor meeting to order at 7:00 p.m.
Present were Town Board members Chairperson Betty Hoenisch, Supervisor Tad Schult, Supervisor Shore, Town Attorney Randy Frokjer, Zoning Administrator Rich Grefe and Plan Commission member Tom Ellias.  Also, present were Ben, Rich and Katie McEvoy, potential purchasers and Gilbert and Virginian Erdman, sellers, Erdman’s daughter Laura Bramschreiber and their surveyor Gary Krueger.  Present were Jim Behrendt, John Stroesenruether, Gerald Tritten, Todd Nienow, Steve and Cammy Krause the property owners that adjoin the Erdman property and a few community members.
Chair Hoenisch distributed maps of the Erdman property. 
Chair Hoenisch asked that everyone present introduce themselves.
Chair Hoenisch explained that the meeting had been called to discuss road access for the property owners.  Erdman’s would like to sell their approximately 55 acres with the pond to the McEvoy’s.  The McEvoy’s would like to build two homes however there is no road frontage for that property. 
Chair Hoenisch explained that the current properties were grandfathered in January 1, 1998 when Town Zoning Ordinance was adopted, however the Town cannot issue building permits for two new homes because it would make the property more illegal non-conforming. 
Chair Hoenisch explained that the property owners had been asked to bring any abstracts, deeds, title insurance or easement documents they may have for their properties to help the Town determine how the property owners are accessing their properties.
Chair Hoenisch explained that she and Zoning Administrator Rich Grefe had held a meeting with Ben and Rich McEvoy and surveyor Gary Krueger on September 12, 2007 to discuss road possibilities such as a U shaped road which would give everyone access on a Town road.  She explained that this would clear up a lot of old access issues and make it easier for emergency vehicles to get to the properties.
On September 18, 2007 Mr. Grefe and she had stopped to measure the Behrendt and Tritten setbacks.  At that time Jim Behrendt, Ed Krause, Steve Krause, Cammy Krause and Gerald Tritten walked their driveway with them, showed them the property stakes and explained how they had purchased their properties with the current access. 
When checking setbacks on September 17, 2007 it was determined that in order to make a U shaped road the Town would need to give front yard setback variances to the Behrendt’s and Tritten’s.  Zoning Administrator Rich Grefe felt that the Town would be correcting one problem and  but creating another problem.  The property owners stated that they did not want the driveway that the three properties use to be turned into a Town road.   They did not to contribute toward the building of a new road.
Chair Hoenisch explained that Jim Behrendt had stopped several times in the past week regarding the access issues.  Mr. Behrendt informed her that he has spoken to Tritten’s and Krause"s and they would like to keep their current access.  She said that we are here today to try to work cooperatively together to try to correct old problems and do what is best for the Town long term.  All of these old problems are showing up now and have to be dealt with due to property sales and urban growth.
Attorney Frokjer explained that the Town did not have to become involved but when the McEvoy’s called the Town regarding their proposed building ideas the Town felt it was an opportunity to be proactive to work with residents to clear up the old access issues.
Attorney Frokjer reviewed the easement deeds and title insurance documents that the property owners had brought to the meeting.
It was determined that due to setback issues it was best to allow the Behrendt’s, Krause’s and Tritten’s to continue to use the south driveway access that crosses Behrendt’s and Erdman’s property as their access since their driveway easements run with the land.
Discussion followed to have a north road with a cul de sac built in the 66 foot road reservation that the McEvoy’s, John Stroesenruether and Todd Nienow would use to access their properties.
Ben and Rich McEvoy explained that they had negotiated a selling price with the Erdman’s and that they would be responsible for building the road. 
Discussion followed that the current road that the trucks had used to haul sand and granite from Erdman’s pit  was not in the center of the road right of way, consequently McEvoy’s would like to work with Mr. Stroesenruether and Mr. Nienow on deeding land to them to bring them up to the road.  In exchange the McEvoy’s were hoping for some cooperation on the road building cost.
Attorney Frokjer explained that McEoy’s, Mr. Stroesenruether and Mr. Nienow should meet to determine those issues because that is something that the Town should not be involved in.  McEvoy’s stated that they will work with their surveyor Gary Krueger to create a map showing the new proposed road and what parcels will be deeded to bring the properties to the new road.  They will then meet with Mr. Stroesenruether and Mr. Nienow.
 Chair Hoenisch explained that they will need to do a land division application which their surveyor Gary Krueger is very familiar with.  When that is finished they will need to do a road development agreement with the Town. 
Attorney Frokjer explained that this may take several months since the surveying needs to be completed.  CSM’s with parcel ID #’s need to be created and recorded so they can be referenced in the road agreement.
Ben and Rich McEvoy had questions on a separate parcel for their honey bee business and access off the cul de sac for that parcel.  Surveyor Gary Krueger had questions on surveying that parcel and the number of lots off a cul de sac. Discussion followed on the importance of proper planning now due to future access issues.
The Board thanked everyone for attending and their cooperation in this matter.
Supervisor Shore made a motion to adjourn at 8:25 p.m., seconded by Supervisor Schult.  Motion carried.
