The Board of Supervisors of the Town of Maine held a regular monthly meeting at the Town of Maine Town Hall on Monday, November 14, 2011. Accounts Payable were reviewed at 6:30 p.m. with General Business at 7:30 p.m.

Board of Supervisor Meeting
The Board of Supervisors of the Town of Maine held a regular monthly meeting at the Maine Town Hall on Monday, November 14, 2011 at 6:00 p.m.
Chairman Tad Schult called the meeting to order at 6:00 p.m.
Present were Chairman Tad Schult, Supervisor Wes Schoepke, Supervisor Keith Rusch, Treasurer Marilyn Grunenwald, Clerk Betty Hoenisch, Zoning Administrator / Building Inspector Rich Grefe, Town Attorney Randy Frokjer and community members.
6:00 p.m. – Meet with Don Wild from Edward Jones regarding Town retirement account.
Don Wild from Edward Jones was present to discuss the Town’s retirement account. Introductions were made. Mr. Wild explained that public works employees are very happy with the 457 retirement accounts because even with the bad economy they are doing well with their investments. Mr. Wild explained how the Town’s retirement account is setup and how that has been working. Town Board members had questions regarding investing with Edward Jones. Mr. Wild stated he would be happy to meet with the Town Board member individually regarding a possible account with Edward Jones. The Town does not contribute toward a 457 retirement account for Town Board members, however the officials could contribute on their own using a paycheck deduction the Town currently has in place.
6:30 p.m. - Accounts payable bills were reviewed.
7:00 p.m. – Meet with Shana Czech from Aflac regarding town sponsorship.
Ms. Czech had emailed the clerk that she was unable to attend the meeting.
The pledge of the allegiance was recited.
Chairman Schult called for a motion to approve accounts payable bills.
Supervisor Rusch made a motion to approve bills, seconded by Supervisor Schoepke. Motion carried.
Clerk’s report:
Clerk Hoenisch explained the October 12, 2011 and October 17, 2011 minutes need to be approved. Chairman Schult stated a motion is needed to dispense of the reading of the minutes and approval of the minutes. Supervisor Rusch made a motion to approve the minutes, seconded by Supervisor Schoepke. Motion carried.
Chairman’s report:
Chairman Schult reported that Leon at Service Motors has agreed to do repair work on the grader. This work was placed in the 2012 budget and Service Motors agreed to wait until January for payment.
Chairman Schult reported the Town was approved for a $25,000.00 Town Road Improvement Grant (TRI) at the November 9, 2011 County Highway TRI Grant meeting.
Supervisor’s report:
Supervisor Schoepke reported he had a busy month personally and did not have anything to report for the Town.

Board of Supervisor Meeting
Supervisor Rush reported he received a call on granite that was dragged out onto to Falcon Drive which could be a hazard situation. Mr. Rusch called and left a message for Eugene Dehnel requesting that he clean up the granite his equipment had deposited on Falcon Drive.
Supervisor Rusch asked Attorney Frokjer to explain the progress of the new zoning ordinance. Attorney Frokjer stated he has made a lot of progress and will email the ordinance to the clerk on Tuesday. Supervisor Rusch asked the clerk to print copies to be reviewed.
Treasurer’s report:
Treasurer Marilyn Grunenwald reported on Town bank accounts ending October 31, 2011.
Money Market Account Balance 9/30/2011 - $ 69,478.38
Deposits and Interest – $ 68,475.59
Expenses - $ 70,537.06
Money Market Account Balance 10/31/2011 - $ 67,416.19
Town of Maine Checking Account - $ 9,162.34

Chairman Schult called for a motion to approve treasurer’s report. Supervisor Schoepke made a motion to approve the treasurer’s report, seconded by Supervisor Rusch. Motion carried.
Zoning Administrator’s report:
Mr. Grefe reported he issued four new permits in October. He issued permits for one accessory building, one residential addition, one commercial addition and one wrecking permits. He also conducted ten inspections in October.
Other business:
Discussion and possible action to approve Jim Behrendt as Town Humane Officer.
Chairman Schult asked Supervisor Rusch to explain what he was able to find out from calls to other townships that attended the September Humane Officer training with Mr. Behrendt. Supervisor Rusch
explained that the towns he called are just getting started like Maine. They are proposing to pay $50.00 per call and will reimburse officer for their training.
Clerk Hoenisch stated she called Horton Insurance and there is very little cost to add Mr. Behrendt to Town’s insurance policy as Humane Officer. The Town already has Jack Eckardt insured as constable and Humane Officer employee coverage would fall in that category.
Clerk Hoenisch stated she also called Mary Kirlin and Lisa at the Humane Society regarding the Town’s current contract with them. Ms. Kirlin suggested the Town review section 916 of Marathon County’s general code of ordinance. Per Ms. Kirlin the Town can have its own Humane Officer to handle town animal issues, however then it will be the Town’s responsibility to write abatement orders and go to the district attorney etc. Currently the County does this on the Town’s behalf if there is an

animal issue. Town can surrender animals to the Humane Society; however Ms. Kirlin was concerned about large quantities being surrender at one time, because their facility is usually full. Animals brought in will have housing, vet charges, etc billed to the Town. Ms. Kirlin suggested the Town check its ordinance to be sure Town can put legal and other expenses on property lien. Ms. Kirlin asked why the Town was considering having its own Humane Officer and Clerk Hoenisch explained the past animal issues and problems the Town has experienced with the County Humane Officer not being available when needed, due to her work load. Ms. Kirlin stated it’s not going to break their heart if the Town employs its own officer. She offered that the Town attorney could call her if he has questions.
Attorney Frokjer stated the Town should call the Humane Society and asked them to release the Town from the current contract with Marathon County and reference in the release letter that the Town can continue to surrender animals. Supervisor Schoepke made a motion to approve Jim Behrendt as Town’s Humane Officer at $40.00 per call, 0.45 cents per mile and reimbursement for continuing education until he hires out to other communities, seconded by Supervisor Rusch. Motion carried.
Discussion and possible action regarding 1385 Rainbow Drive, Merrill, WI inspection.
Chairman Schult asked Zoning Administrator Grefe to explain this issue. Mr. Grefe explained he had been trying to gain access to property with Five Brothers Company, however they lost the account. Aaron Pince from Lenders Asset Management took over the account for the bank that foreclosed on property. Saturday, November 12, 2011 he and Clerk Hoenisch conducted an inspection with Mr. Pince to investigate the mold complaints and took pictures of the property. Mr. Grefe reported the outside needs maintenance and there is an odor of mold on the upstairs, which seems to be coming upstairs from the lower level that has significant mold issues. He checked the attic and the attic was fine. Mr. Grefe stated the lower level mold conditions should be able to be remediated. HAVAC will need to be cleaned or replaced and there are UDC issues with the electrical and plumbing in the lower level. Mr. Grefe explained he is currently working on an inspection letter stating permits are required and mold will need to be remediated. The inspection letter lists what the Town is going to require for remediation before someone can occupy that home. He will also create a “Make Safe Notice” for that property. Mr. Grefe will email inspection letter and “Make Safe Notice” to Lender Asset Management and the auction company tonight so they are aware of what the Town is requiring before they auction the property at 6:00 p.m. on November 15, 2011. Supervisor Schoepke. made a motion to have Mr. Grefe post a “Make Safe Order” and inspection letter at 1385 Rainbow Drive, seconded by Supervisor Rusch. Motion carried. Mr. Grefe stated he will post those notices on the door of that property on his way home this evening. Attorney Frokjer also stated that Mr. Grefe should be present at the November 15, 2011 auction to answer questions from potential buyers.
Discussion and possible action on DOT CTH U / K Interchange road right of way plat.
Chairman Schult explained the Town gave the DOT permission to acquire land needed for the CTH U / K Interchange. Tom Krizenesky from the DOT sent the land acquisition plat to the Town for approval.
Attorney Frokjer explained state statutes have an exception for road right of way plat approval. The DOT is laying out what they need for the highway project and they need approval from the Town with authorization for the Town Chairman to sign the documents. Supervisor Rusch made a motion to approve the DOT’s CTH U / K Interchange road right of way plat and give Chairman Schult the authority to sign the plat, seconded by Supervisor Schoepke. Motion carried.

Board of Supervisor Meeting
Discussion and possible action on Maine Fire Department application.
Acting Chief Bob Pound explained the fire department’s application was revised based on recommendations from Attorney Frokjer and McGrath Consulting. The application presented tonight was reviewed and approved by the fire department officers. Supervisor Schoepke made a motion to approve the Fire Department application, seconded by Supervisor Rusch. Motion carried.
Discussion and possible action on 2012 Emergency Services contract with the Town of Berlin.
Clerk Hoenisch stated she made the revisions requested by the Town Board at their October 12, 2011 meeting. The land sections in the Town of Berlin that Maine Fire provides service for are listed in section one. The new billing section five and emergency service charge section six were added as allowed per Town’s Emergency Services municipal code 12. The Town Board needs to determine contract amount for 2012, she stated. Supervisor Schoepke made a motion to approve the Town of Berlin contract as revised with a 3% increase for 2012, seconded by Supervisor Rusch. Motion carried.

Clerk Hoenisch stated she made the revisions requested by the Town Board at their October 12, 2011 meeting. Section five billing was revised due to past billing issues with the corn drying facility fires. Section six emergency service charges were added as allowed by Town’s Emergency Services municipal code 12. Special charge for equipment was moved to section five billing. Clerk Hoenisch explained that Brokaw’s Clerk Utecht called stating their attorney was going to contact Maine to schedule meeting regarding contract and other issues, however that was almost two months ago and she has not heard from Brokaw’s attorney. The Town Board needs to determine contract amount for 2012 so these contracts can be mailed, she stated. Supervisor Schoepke made a motion to approve the Village of Brokaw contract as revised with a 3% increase for 2012, seconded by Supervisor Rusch. Motion carried.
Discussion and possible action on Town Board mileage.
Chairman Schult explained that with high fuel prices the 0.36 cents per mile the Town Board is receiving for mileage is not cutting it. He stated there was discussion on this issue at the October 17, 2011 Budget workshop and felt the mileage reimbursement needs to be increased. Supervisor Schoepke made a motion to approve 0.45 cents per mile for Town Board official’s mileage reimbursement effective December 1, 2011, seconded by Supervisor Rusch. Motion carried.

Clerk Hoenisch stated she called Chip Kramer from Life Quest to discuss the contract Maine has with them for fire department billing services. Mr. Kramer feels they can cancel the Town’s contract, which was 12 months from July 2010 to July 2011 and then 36 months to July 2014. Explained problems getting them the information for billing. Mr. Kramer will take the cancellation to their committee.

Board of Supervisor Meeting
Supervisor Rusch asked about Marathon County’s Guideline for Concealed Carry Weapons that Acting Chief Pound had submitted to the Town Board. Discussion followed on whether or not the Town property should be posted as no weapons allowed. Pros and cons were discussed along with information from Attorney Frokjer and Acting Chief Pound on how other governmental entities are handling the concealed carry weapons issue. Attorney Frokjer stated that this would need to be a Town Board agenda item if the Town Board wants to make a decision.
Chairman Schult stated the next Board of Supervisor Meeting would be Monday, December 12, 2011 at 7:30 p.m. with bill approval at 6:30 p.m. and the Budget Public Hearing and Special Town Budget Meeting will be held on Wednesday, November 16, 2011 at 7:30 p.m.
The Town Board reviewed the preliminary budget to be presented at the Budget Public Hearing and Special Town Budget Meeting on Wednesday, November 16, 2011 at 7:30 p.m.
Adjournment. Chairman Schult called for a motion to adjourn. Supervisor Schoepke made a motion to adjourn at 9:20 p.m., seconded by Supervisor Rusch. Motion carried.
