May 4, 2007 Special Board of Supervisors Meeting
1. Call meeting to order at 1:00 p.m. – Betty Hoenisch, Chairperson
2. Presentation and discussion on Smart Growth Law and Comprehensive Land Use Plans – Jay Verhulst and State Representative Jerry Petrowski.
3. Adjournment.

A Special Meeting was held on Friday, May 4, 2007 at the Town of Maine Town Hall at 1:00 p.m. The purpose of the meeting was a presentation on Smart Growth Law.
Present were Jay and Sandra Verhulst, State Representative Jerry Petrowski, Town Board members Betty Hoenisch, Sue Shore, Marilyn Grunenwald, Town Attorney Randy Frokjer, Concerned Citizens committee chairperson Judy Bayba and community residents.
Jay Verhulst showed a power point presentation on Smart Growth law.
Mr. Verhulst distributed several maps and other materials on Smart Growth. He explained that if a Town Board adopts a plan under State Stature 66.1001 then that plan is law.
There have been problems in Oregon with the Smart Growth Law which he explained in detail how the people loose their right to own land and use it how they wish.
Discussion and questions followed. Attorney Frokjer asked Representative Petrowski how this law got passed. Representative Petrowski explained that former Governor Thompson had included this legislation in a package of other legislation. His opinion was that this may have been part of the former governor’s political plan to obtain his White House job.
Attorney Frokjer asked what the chances were to appeal this law. Representative Petrowski felt that with all the urban lobbyist it will be difficult to repeal however he hopes that because there is no funding available in Governor Doyle’s budget that they may be able to extend the Land Use adoption timeline to the year 2015.
Attorney Frokjer expressed concerns regarding enforcement of the Town’s ordinances if the Smart Growth Law is not repealed. He feels that because the Town is also revising their zoning ordinance the Land Use Plan and zoning ordinance revisions should be tied together.
Discussion followed on the issues related to the Town doing a resolution with Marathon County for part of a grant which was used for an consulting firm to attend meetings and develop the Town’s plan.
Chairperson Hoenisch explained that the County will loose 25% of the Town’s portion of that grant. She said that the Town’s plan is ready to be presented at a public hearing, however at the May 7th Plan Commission Meeting, a motion was made to table the plan until the zoning ordinances are revised. Mr. Verhulst recommended that the Town wait with the plan adoption.
Attorney Frokjer talked about the loss of Town power and the need to work well with the County. He said that this is just another stumbling block for the Towns who are already at the bottom of the ladder and yet the most efficient type of government. Town’s do not have sole automity and need to work well with the county.
Chairperson Hoenisch asked what role the Town could take to get the Smart Growth Law repealed. Mr. Verhulst explained that Town’s could do resolutions and contact their legislatures to repeal the Smart Growth Law.
The Verhulst’s offered to attend another meeting with the Plan Commission and other neighboring communities.
