The Board of Supervisors of the Town of Maine will hold a special meeting in the Maine Town Hall on Monday, June 29, 2009 at 6:00 p.m.

Agenda


1. Call to order - Betty Hoenisch, Chairperson
2. Discussion and possible action to award road bids.
3. Discussion and possible action to approve Liquor, Amusement, Tobacco and Operator’s Licenses for Bryan’s IDK, Mirage, Red Granite Bar, Richard’s Supper Club, Schmidt’s Ballroom/Bar and Rib Mountain Bowmen.
4. Discussion and possible action to approve Tetra Tech’s proposal for construction oversight services for the N. Fourth Avenue reconstruction project.
5. Discussion and possible action to approve the Fire Department to issue burn permits and make campfires exempt from permits.
6. Travel to N. 72nd Avenue to meet with the Town of Berlin Board of Supervisors regarding road agreement and maintenance policy for shared town roads.
7. Travel back to town hall to meet with Town of Berlin Board.

Special Board of Supervisors Meeting



A Special Meeting of the Board of Supervisors for the Town of Maine was held at 6:00 p.m. Monday, June 29, 2009 in the Town Hall, 6111 N. 44th Avenue, Wausau, WI 54401.

Present were Chairperson Betty Hoenisch, Supervisors Tad Schult and Wes Schoepke, Clerk Tammi Walter, Treasurer Marilyn Grunenwald and road contractors.

Chair Hoenisch called the meeting to order.


Chair Hoenisch explained that the first item of business was discussion and possible action to award road bids. The bids for granite were:

1. Ladick Road Materials bid $5.95 per ton delivered north of Hillcrest Drive. $5.45 per ton delivered south of Hillcrest Drive. $5.45 per ton delivered to town garage stockpile.

Supervisor Schult made a motion to accept Ladick Road Materials bid, seconded by Supervisor Schoepke. Motion carried.

The bids for crushed road base were:

1. Anderson Brothers and Johnson bid $6.60 per ton delivered to 60th Ave-(from Decator Dr south to Falcon Dr). $6.30 per ton delivered to 60th Ave-(from Hillcrest Dr north to Cty Rd A). $6.45 per ton delivered to Hillcrest Dr-(from 60th Ave west to N 72nd Ave). $6.45 per ton delivered to N 72nd Ave-(from Hillcrest Dr north to Cty Rd A). $7.45 per ton delivered to Brentwood Rd-(from Burlington Dr east to Beecher Ave). $7.45 per ton delivered to Belmont Rd-(from N 4th Ave west to N 6th Ave). $7.45 per ton delivered to N 6th Ave-(south from Belmont Rd to City limits). $6.60 per ton for the 90 foot diameter cul de sacs on 53rd, 55th and 57th Ave. $6.40 per ton if material is needed for Honey Bee Ln and Laredo Ln.

Supervisor Schult made a motion to accept Anderson Brothers and Johnson’s bid, seconded by Supervisor Schoepke. Motion carried.

The bids for shouldering were:

1. Anderson Brothers and Johnson bid $11.45 per ton

2. Ron Christiansen Trucking bid $9.95 per ton

Supervisor Schult made a motion to accept Anderson Brothers and Johnson’s bid, seconded by Supervisor Schoepke. Motion carried.

The bids for pulverizing were:

1. American Asphalt bid $1354.50 for Brentwood Rd 739 feet-(Burlington-Beecher). $1833.00 for N 72nd Ave-(Cty Rd A south 1000 feet).

Supervisor Schoepke made a motion to accept American Asphalt’s bid, seconded by Supervisor Schult. Motion carried.

The bids for paving with 2 ½ inches of compacted hot asphalt :

1. American Asphalt bid $81,804.68 for 60th Ave-(Decator Dr-Falcon Dr). $74,464.28 for 60th Ave-(Hillcrest Dr-Cty Rd A). $72,221.38 for Hillcrest Dr-(60th Ave-N 72nd Ave). $73,689.46 for N 72nd Ave-(Hillcrest Dr-Cty Rd A). $10,317.34 for Brentwood Rd-(Burlington-Beecher). $9583.30 for Belmont Rd-(N 4th Ave-N 6th Ave). $12,560.24 for N 6th Ave-(Belmont Rd-City Limits). $12,845.70 for 53rd, 55th and 57th Ave-(90’ cul de sacs).

Supervisor Schult made a motion to accept American Asphalt’s bid, seconded by Supervisor Schoepke. Motion carried.

The bids for paving with 3 inches of compacted hot asphalt (Sub division road rates for proposed Town roads):

1. American Asphalt bid $16,597.46 for Honey Bee Ln-(Cty Rd K-west). $15,904.20 for Laredo Ln-(Cty Rd K-west).

2. RC Pavers bid $19,708.00 for Honey Bee Ln-(Cty Rd K-west). $19,228.00 for Laredo Ln-(Cty Rd K-west).

Supervisor Schoepke made a motion to accept American Asphalt’s bid, seconded by Supervisor Schult. Motion carried.

The bids for chip seal were:

1. Fahrner Asphalt Sealers bid $14,414.00 per mile.

2. Scott Construction bid $14,584.00 per mile.

Supervisor Schult made a motion to accept Scott Construction’s bid, seconded by Supervisor Schoepke. Motion carried.

2. Scott Construction bid $14,300.00 per mile.

Supervisor Schoepke made a motion to accept Fahrner Asphalt’s bid, seconded by Supervisor Schult. Motion carried.

The bids for crack filling were:

1. Fahrner Asphalt Sealers bid $1.34 per pound.

2. Allied Blacktop Corp bid $1.119 per pound.

3. American Pavement Solutions bid $1.099 per pound.

Supervisor Schult made a motion to accept American Pavement Solution’s bid, seconded by Supervisor Schoepke. Motion carried.

Supervisor Schult made a motion to accept American Asphalt’s 2nd Option bid totaling $337,939.07, seconded by Supervisor Schoepke. Motion carried.


Next item of business was discussion and possible action to approve Liquor, Amusement, Tobacco and Operator’s Licenses for Bryan’s IDK, Mirage, Red Granite Bar, Richard’s Supper Club, Schmidt’s Ballroom/Bar and Rib Mountain Bowmen. Supervisor Schult made a motion to approve Bryan’s IDK, Mirage, Red Granite Bar, Richard’s Supper Club, Schmidt’s Ballroom / Bar and Rib Mountain Bowmen’s liquor, amusement and tobacco licenses, as long as personal property taxes are paid and to approve Clerk Walter for approving operator licenses that come in throughout the year, pending a satisfactory background check, seconded by Supervisor Schoepke. Motion carried.

Next item of business was discussion and possible action to approve Tetra Tech’s proposal for construction oversight services for the N. Fourth Avenue reconstruction project. Supervisor Schoepke made a motion to approve Tetra Tech’s proposal for construction oversight services for the N. Fourth Avenue reconstruction project, seconded by Supervisor Schult. Motion carried.

Next item of business was discussion and possible action to approve the Fire Department to issue burn permits and make campfires exempt from permits. Chair Hoenisch reported that she has spoken with the DNR on many occasions recently and the DNR has informed her that the Fire Department is the one who receives the notices on what residents can and can not burn, the do’s and don’ts of burning and anything related to burning; not the Town Board. Supervisor Schoepke made a motion that as of September 1, 2009, the Fire Department will issue the Town’s burn permits and family campfires will be exempt from getting a permit after this date, seconded by Supervisor Schult. Motion carried.

Last item of business was to travel to N. 72nd Avenue to meet with the Town of Berlin Board regarding road agreement and maintenance policy for shared town roads.

Town Chair, Supervisors and Public Works lead man John Marquardt traveled to the corner of County Road A and N. 72nd Avenue to meet with the Town of Berlin Board.

Introductions were made. Chairman Jim Sala, Supervisor Sheldon Voigt and Supervisor Harvey Bade were present from the Town of Berlin.

Chairman Jim Sala explained that they were proposing to pulverize N. 72nd Avenue this summer. They would be doing some ditching and moving the utility poles if they can get cooperation from the property owners along that portion of N. 72nd Avenue. If they get the cooperation they feel is needed to complete the ditching work and tree removal in the road right of way they will hopefully pave that road next year. If they do not get cooperation then that road will stay a granite road.

John Marquardt asked if they planned to reshape Schmidt’s parking lot approach or ditch to divert the water that currently runs across the road and creates a dangerous icy condition. Both Boards agreed that Schmidt’s owner should be contacted regarding some excavating to correct the drainage problem.

Supervisor Voigt explained that they have a moisture problem on N. 72nd Avenue which creates potholes and they spend a lot of money patching. He offered to show the Maine Town Board where the problem areas are. The group traveled north on N. 72nd Avenue and stopped several times to discuss the problems.

Supervisor Schult asked what trees were going to be removed. Chairman Sala said all of the trees in the right of way need to be removed because there are new laws being passed that create extra liability for a Town. He explained that Dan Krueger’s trees would definitely have to be removed so they can ditch better to get the proper drainage slope to move the water south.

Supervisor Schult stated that Krueger’s were the high point of N. 72nd Avenue therefore their ditch needs to be filled in which would force the water to flow south. Measurements were taken by John Marquardt and Supervisor Schult. They determined that Krueger’s trees were twelve feet off of the paved surfaced and Supervisors Schult and Schoepke both felt that was a safe distance.
Berlin’s Board disagreed. Supervisor Voigt explained that the tree roots hold moisture and explained that Berlin wants to open up the entire sixty six foot road right of way.

Supervisor Schoepke asked what they were proposing for the home at the northwest corner of County Road A due to its close proximity to the road right of way. Supervisor Voigt said that they would narrow the road at that point to accommodate that property.

Krueger’s came out and joined in the discussion. Supervisor Schult asked if they ever had water in their ditch and they said no. He explained what Town of Berlin was proposing.

Discussion followed regarding the old shake of the hand maintenance agreements and possible re-construction of roads that are shared by two municipalities.

Chair Hoenisch explained that she called the Towns Association attorney and he recommended that new agreements be approved that clearly spells out what is maintenance and what happens when a road is repaved. The Town of Maine and the Town of Berlin each receive half of the road aids for this mile so we need to come to some mutual agreement regarding this road. The Town of Maine does not want this road turned back to granite. We were proposing to pave the mile south of County Road A this summer if there was enough funding in our paving budget. We have received complaints from Berlin residents regarding the dust on that portion of N. 72nd Avenue, but why would we pave that mile if you are going to turn the wheel backward and turn this mile back to granite she said.

Mr. Marquardt asked Berlin’s supervisors when this portion of N. 72nd had been paved and they did not know. Chair Hoenisch said that she did not believe the road deterioration was a moisture problem but rather pavement that had gone past its life expectancy. Once the pavement becomes so cracked the surface water goes into the base, which then causes further deterioration of the road.

Discussion followed on road right of way, building setbacks, ditch and tree issues the Town of Maine is going to experience with the portion of N. 72nd Avenue that is south of County Road A. Chair Hoenisch suggested that everyone present travel that portion of road to discuss what needs to be done to upgrade that mile of N. 72nd.

The first stop was to view the property on the SW corner of County Road A that has a fence in the road right of way along the entire length of the lot. Mr. Marquardt stated that the fence is a problem when they wing snow.

On the east side of N. 72nd Avenue Schmidt’s Bar and Burn’s rental home will have severe building setback and exist issues if the Town tries to widen that road.

The third stop was at the cemetery on the west side of N. 72nd Avenue. Road right of way was measured. Ditching issues and graves in the road right of way will need to be addressed to widen the road.

The fourth stop was at Dan Krueger’s brick farm house. Road right of way was measured. All of Krueger’s beautiful maple trees will need to be removed to widen the road.

The group discussed the elk deer farm on the east side of N. 72nd Avenue. It was determined that the entire west fence line was in the road right of way.

Maine Supervisors asked Krueger’s about the traffic volume and they said there was a very low vehicle count on N. 72nd Avenue.

Maine Supervisors said they realized that ditching and tree removal needed to be done, however what does a town gain by putting their entire year’s road budget into a very low traffic rural road. When a new road is built in Maine it is built to town specifications with a sixty six foot cleared right of way, a twenty two foot paved top, three foot wide shoulders and at least three to one sloped ditches. When we reconstruct an old existing road we do the best we can to make it a safe, up graded road without spending three years budget on one mile. We try to be cost effective with tax dollars they said.

Special Board of Supervisors Meeting


Berlin’s Supervisors suggested that Maine Supervisors drive several of Berlin’s town roads that they have upgraded with new ditches and road right of way clearing. They said Maine would be able to see how Berlin would like to upgrade N. 72nd Avenue.

Chair Hoenisch suggested that Berlin and Maine hold another meeting to draft road maintenance and road reconstruction agreements. Perhaps we can come up with a plan for the reconstruction of N. 72nd Avenue in 2010.

Chair Hoenisch, Supervisor Schoepke, Supervisor Schult and John Marquardt drove to Naugart Drive, Rainbow Drive and Mitchell Lane to view Berlin’s fairly recent granite road projects.

Motion by Supervisor Schult to adjourn at 9:30 p.m., seconded by Supervisor Schoepke. Motion carried.
