Town of Maine Supervisors
June 29, 2005
Chair Hoenisch called the meeting to order at 8:07 a.m.
Chairperson Hoenisch entertained a motion to convene into closed session pursuant
to State Statute 19.85(1)(e)(g) for the purpose of deliberating on termination of Town’s Legal Agreement and Stipulations and Orders for Withdrawal of Attorneys on Town of Maine Court Cases.
Supervisor Wanke made that motion, seconded by Supervisor Zernicke. Motion carried.
Discussion of the Town’s Legal Agreement and Stipulations and Orders for Withdrawal with the present Town Attorneys were discussed.
Chair Hoenisch entertained a motion to convene in open session. Supervisor Zernicke made that motion, seconded by Supervisor Wanke.
Item A: Supervisor Zernicke made a motion to terminate the legal representation with the Hess Law Firm, Supervisor Wanke seconded that motion. Motion carried.
The contract was signed to dismiss the current legal contract.
Item B-A motion was made to withdrawal the Hess Law Firm on case 05-cv-137 Town of Maine vs. Town of Maine
Supervisor Zernicke made a motion to have the Town’s attorney to withdraw but before withdrawing to amend the motion agreeing to the Hess law firm withdrawing from the case that before the Hess Law Firm will draft a letter stating to Mr. Burnell Utech that he does not have to answer the complaint until October 1, 2005., allowing the Hess law Firm to withdraw from legal council, Seconded by Chair Hoenish to allow the attorney to withdrawal. Motion carried.
The contract was signed at 9:45 a.m.
Item c-
Supervisor Zernicke made a motion to have the Hess Law Firm withdraw on case number 04-CV-938, Town of Maine vs. Century Excavating Plus, seconded by Supervisor Wanke. Motion carried.
Item D- Supervisor Zernicke made a motion to have the Hess Law Firm withdraw from case # 04-CV-879, Town of Maine vs. Gene Roets, Supervisor Wanke seconded that motion, motion carried.
Supervisor Wanke made a motion to adjourn, seconded by Supervisor Zernicke. Motion carried.
