Members of the Plan Commission present included: Chairman Utecht, Mark Stubbe, Jeff Utecht, Ed Bohte, Kurt Rowe, and Deb Klopp. Also present was Atty. Byll Hess and Jeff Krueger along with members of the community.
Chairman Utecht called to order the public hearing on the petition to rezone Remedial Engineering at 4080 N. 20th Avenue from BP - Business Park to B 1-E Existing Neighborhood Retail and Service. REI would like to build an addition and its current building does not meet the setbacks of the BP District. Tom Radenz stated REI would propose building a 54'x 50' addition on the North side of the building. This addition would be used for office space. Mr. and Mrs.Piasik addressed their concerns about parking and gas pumps being stored outside. It was explained that the gas pumps were drained prior to leaving the gas site, and the "building addition would only be for office and not create more outside storage". As there were no further public comments, a motion to close the public hearing at 7:50pm.by Jeff Utecht, Ed Bohte seconded. The motion carried without opposition.
Chairman Utecht called the Plan Commission meeting to order at 7:50pm.
The first item of business included the discussion and possible action to rezone Remedial Engineering from BP - Business Park to B 1-E Existing Neighborhood Retail and Service. Copies of the petition and map were sent to each member of the Plan Commission. Atty. Hess has drafted a Zoning Amendment Determination for the Plan Commission to review. Atty. Hess advised there cannot be outdoor storage, as all business needs to be in an enclosed building. Mr. Radenz stated he "knows it's an issue, but we haven't had time to work on it". The Plan Commission members told REI representatives they cannot have outside storage, and they need a plan to remove the current storage. It was determined that REI would need to work with Jeff Krueger on this plan. Ed Bohte made a motion to accept the zoning amendment determination as follows: The Town of Maine Plan Commission recommends the approval of the petition of the Town of Maine to amend the zoning ordinance for property located at 4080 N. 20th Avenue from BP - General Business Park to B 1-E Existing Neighborhood Convenience Retail and Service. Based on the above review, investigation and discussion, the Plan Commission determined: Prior to January 1, 1998, the property was zoned B-1 Neighborhood Shopping District, the professional office building and use located on the property lawfully existed on December 31, 1997, rezoning this property to B 1-E is consistent with the land use plans adopted by the Town and with the reasons for establishing the B 1-E District, and the requested rezoning and resulting uses that will be allowed comply with the intent and purpose of the Town Zoning Ordinance. Kurt Rowe seconded, the motion carried without opposition.
The second item of business was to schedule a Special Plan Commission meeting to work on maps from the May 27th Sub Area meeting. The meeting was scheduled for Tuesday, July 27, 2004 at 7pm.
Kurt Rowe made a motion to adjourn at 8:12pm, seconded by Jeff Utecht. The motion carried without opposition.
