The Board of Supervisors of the Town of Maine will hold a special meeting on Monday, July 6, 2009 at 6:00 p.m.
Agenda
1. Call meeting to order at 6:00 p.m. – Betty Hoenisch, Chairperson
2. Meet with the Town of Berlin Board of Supervisors regarding road maintenance and road reconstruction policies for N. 72nd Avenue.
3. Discussion and possible action on road maintenance and reconstruction agreements for N. 72nd Avenue.
4. Adjournment.

Special Board Meeting
A Special Board of Supervisor meeting was held Monday, July 6, 2009 at 6:00 p.m. in the Maine Town Hall.
Chair Hoenisch called the Special Board meeting to order.
Present were Town Board members Chair Betty Hoenisch, Supervisor Tad Schult, Supervisor Wes Schoepke, Town Attorney Randy Frokjer and public works employee John Marquardt.
Chair Hoenisch explained that Town of Berlin’s new Chairman Jim Sala stopped at the office to inform Maine that the Town of Berlin plans to pulverize the mile section of N. 72nd Avenue that is north of County Road A. Berlin wants to clear the entire sixty six foot road right of way, which includes moving the utility poles, tree removal and ditching. Mr. Sala informed Chair Hoenisch that if Berlin cannot get cooperation from the Maine residents on the east side of N. 72nd Avenue then that portion of N. 72nd Avenue will not be repaved.
Discussion followed regarding the on-site meeting on June 29, 2009 with Town of Berlin’s Chairman and Supervisors.
Attorney Frokjer said it would be great to talk to the Town of Berlin about possible options or agreements. Chair Hoenisch explained that she invited the Town of Berlin to this meeting. Mr. Sala called today to say they would not be attending tonight’s meeting because his Town Board has not had a chance to meet to discuss the N. 72nd Avenue issues.
Supervisor Schoepke expressed his concern that once that road is pulverized it may not be repaved and felt Maine needed to get a paving date in writing from Berlin. He also did not agree with Berlin’s plan to widen the sections of N. 72nd that are mainly agriculture and where there are building setback issues the road will be left at its current width.
Supervisor Schult stated he did not feel Maine’s property owners on the east side of N. 72nd Avenue should be impacted by the ditching, tree removal and widening that is not necessary. He also had concerns about the complaints Maine will receive when that road is pulverized and becomes a dusty, rough granite road. He said look at the problems we experienced and tires the town replaced when Rainbow Drive and Brandenburg Avenue were pulverized last summer.

Special Board Meeting
Chair Hoenisch explained that she called the Towns Association attorney and was told new agreements should be approved with the Town of Berlin spelling out shared road maintenance and road reconstruction.
Discussion and questions followed on the laws and liability issues for roads that two municipalities share.
The supervisors asked Attorney Frokjer if state statutes would allow each township to maintain their own portion of a shared road. Options and different approaches for maintenance were also discussed.
Attorney Frokjer asked John Marquardt about the maintenance on that portion of N. 72nd Avenue. Mr. Marquardt explained that the Town of Berlin does not have a full time road crew, consequently we go out to plow at different times as each township deems necessary. He felt there was a fair sharing of snow plow services on N. 72nd Avenue; however the majority of the patching on that road has been done by Maine.
Attorney Frokjer said that another option would be an agreement between the Towns of Berlin and Maine allowing Maine to collect all the road aids for N. 72nd Avenue. This agreement would state that Maine will do all the snow plowing and minor maintenance such as patching and grading. Major road reconstruction costs such as repaving could be shared equally as part of that agreement he said.
Attorney Frokjer suggested that a letter be sent to Town of Berlin with the road maintenance and reconstruction options discussed this evening. It would be great to extend another invitation to the Town of Berlin to discuss the proposed options and agreements.
Supervisor Schoepke felt it was best to have Attorney Frokjer draft a letter and Supervisor Schult agreed. Attorney Frokjer said he would draft a letter on Tuesday.
Supervisor Schult made a motion to adjourn the meeting at 7:20 p.m., seconded by Supervisor Schoepke. Motion carried.
