OFFICIAL NOTICE AND AGENDA
The Board of Supervisors of the Town of Maine will hold a special meeting in the Maine Town Hall on Monday, July 27, 2009 at 5:00 p.m.
Agenda
1. Call meeting to order - Betty Hoenisch, Chairperson
2. 5:00 p.m. - Travel to Laredo Lane to meet with Lee Van Der Geest to discuss road specifications.
3. Travel back to Town Hall.
4. 6:00 p.m. - Meet with Saber Drive and Sandy Drive residents regarding culvert replacement project, access issues and alternate route during construction.
5. 7:30 p.m. - Meet with the Town of Berlin Board of Supervisors regarding road maintenance and road reconstruction policies for N. 72nd Avenue
6. Discussion and possible action on road maintenance and road reconstruction agreements for N. 72nd Avenue for the Town of Berlin and Town of Maine.
7. Adjournment

Special Board of Supervisors Meeting
A Special Meeting of the Board of Supervisors for the Town of Maine was held at 5:00 p.m. Monday, July 27, 2009 in the Town Hall, 6111 N. 44th Avenue, Wausau, WI 54401.
Present were Chair Hoenisch, Supervisor Tad Schult, Supervisor Wes
Schoepke, Public works employees John Marquardt and Scott Czyan.
Called to order at 5:00 p.m. at Town Hall
Traveled to Laredo Lane to meet with Lee Van Der Geest to discuss road specifications.
Chair Hoenisch introduced new supervisor Wes Schoepke. She stated that the meeting was to discuss road issues that need to be addressed before that road is paved.
Chair Hoenisch asked Mr. Marquardt to explain the problems he experienced when plowing the Laredo Lane approach where it intersects with County Road K. The Town has discussed this issue with the County Highway Department and the County determined that Laredo Lane should be cut back to the west. Mr. Van Der Geest said he would slope the road back to the west and fill in where the road dips toward County Road K.
Mr. Van Der Geest asked how thick the asphalt needed to be and Chair Hoenisch responded that all road agreements require three inches of asphalt when the roads are initially built. She asked Mr. Van Der Geest if he was going to accept American Asphalt’s bid that the Town received and he said he would let her know.
Supervisor Schult explained that there was plenty of road base material on Laredo Lane; however the Town would like Mr. Van Der Geest to grade the road a few times and move some of the material to the south side to level the road better. He explained there are concerns regarding vehicles sliding off the road in icy conditions if it slopes too much. Mr. Van Der Geest stated he would correct that issue.
Next the group traveled to Faith Lutheran Church. Leroy Sense was present and introductions were made.
Chair Hoenisch explained that Sandy Drive was going to be closed for approximately four days to allow Marathon County to replace the culverts. The Town needs to have a route for property owners to travel to get to and from their homes. The Town also needs a route that emergency services vehicles can use during the time the road is closed.
Mr. Sense explained that he is the church trustee and he would like to know where the Town is requesting access thru the church property so he can report to the Church President.
Supervisor Schult explained that he will be contacting Mr. Radtke to obtain permission to use his farm field to travel from Sandy Drive to Faith Church property. The Town is asking permission to cross the area from the north east corner of the church’s parking lot to Mr. Radtke’s field. Mr. Schult explained that the Town will mow the route that the vehicles will use.

Mr. Sense stated that the church wants to be a good neighbor and help the Town and residents out by allowing them to use the church property. He said their concern was if there were rainy conditions while the vehicles were traveling across the church property. The supervisors stated the Town would bring dirt, fill in the ruts and seed it with grass. He requested that the Town provide proof of insurance and a letter stating they will fix any ruts that may occur. Mr. Sense also requested that the Town put up some type of signs showing where the residents could travel across the church property and park their vehicles if necessary. Mr. Sense stated he would attend the 6:00 p.m. meeting at the Town hall to answer any questions.
Next the group traveled to Sandy Drive and discussed the amount of brushing the workers need to do before Marathon County replaces the culverts.
The group then traveled to Saber Drive to view the brushing and guard rail removal on that road.
The group viewed the field entrance on County Road K for a possible route across Don Radtke’s field that connects with Brian Fox’s land as a possible route for the Saber Drive residents to use when that road is closed for culvert replacement. Chair Hoenisch explained that Jim Lewis has also called her to offer their woods road as an alternate route for Saber Drive.
The group traveled back to the Town Hall for a meeting with the Sandy and Saber Drive residents.

Schoepke, Attorney Randy Frokjer, Public works employees John Marquardt and Scott Czyan, Clerk Tammi Walter and Treasurer Marilyn Grunenwald.
Back at the town hall, much discussion followed about Sandy and Saber Drive.
Chair Hoenisch explained that the Town is doing a 50/50 cost share with Marathon County on replacing culverts on Sandy and Saber Drive. She explained the County has tentively planned on starting August 10th and each road should take approximately 4 days, in replacing these culverts. She explained that each culvert is 7’ diameter center with two 6’ side culverts for over flow and will be 40’ wide and not anticipating guard rails.
Resident Mark Bronsteatter asked if by the culvert, it will be pitched down. Supervisor Schult explained they will pitch it down, more like a hill and not like a bank and there will be larger rock on the sides. By the culverts, it will be pitched down.
Mr. Bronsteatter explained that Saber is the most dangerous when you just turn off of Highway K and go down the hill. Supervisor Schult explained that this isn’t up to the Town, that the County is in control of where Saber and Highway K meet. Chair Hoenisch explained that the County has this designed for us and they haven’t shown us the final plans but she thinks that because their coming out 40’ and then they have to get that slope; they’ll have to go a ways back. Chair Hoenisch explained that our goal is to get the County to work with us, they widen their part on K and put turn lanes in and then from the County’s right of way, we’ll widen ours.

Mrs. Lewis asked why there won’t be any guard rails. Road worker John Marquardt explained that they are more of a liability. Statistics say more people have been killed because of guard rails, then they’ve saved.
Mr. Bronsteatter stated that the gravel is a joke on the hill on Saber Drive and wants something more stable then red granite put on this road when this road is re done. Supervisor Schult explained we would put a blacktop mixture on this hill, which would hold it together. He explained that when we fix this road, we would put a 8-10” gravel lift.
Chair Hoenisch explained that she had spoken with Mr. Fox about an access road for Saber. Supervisor Schult explained that he will ride his horse through Radke’s land and possibly Lewis’s land. Chair Hoenisch went on to explain that if anyone has health issues their concerned about, her opinion would be to stay with a family member until the road reopens. Chair Hoenisch explained that she will find out which culvert the county plans on starting first and then she’ll lock them into some definite dates and then let the residents know.
Next item of business was discussion and possible action on road maintenance and road reconstruction agreements for N. 72nd Avenue for the Town of Berlin and Town of Maine. Present was Chair Hoenisch, Supervisor Tad Schult, Supervisor Wes Schoepke, Attorney Randy Frokjer, Clerk Tammi Walter, Treasurer Marilyn Grunenwald, Public works employees John Marquardt and Scott Czyan and Town of Berlin Board members – Sheldon Voigt, Harvey Bade and Jim Sala.
Chairman Jim Sala from Town of Berlin explained that if 72nd Avenue was built by today’s standards, you are disregarding the State Statutes and in violation. This road is deemed a 4 rod road and Berlin wants to make it a 22’ surface with a 3’ shoulder on both sides with the proper ditching. Attorney Frokjer explained that the Town of Maine was referencing in their letter, that there is a specific ordinance which is 82.21 that talks about town roads that are on town lines. Attorney Frokjer stated that to his understanding, there was some kind of hand shake or an understanding many years ago, and we don’t know what the agreement was specifically regarding ditching or utility poles. No one with the Town knows. Residents from both towns are affected and the way to work it out is to sit down and talk it out. The complaints Town of Maine got is that town residents that were going to Town of Berlin, weren’t getting the same treatment as Town of Berlin residents, because they weren’t in the town.
Jim Sala couldn’t find a written agreement on maintenance for 72nd. If we don’t have an agreement, then there’s questions about who’s got what jurisdiction, how do we get it done, concerns of the residents being met. The towns concern’s is what happened within the town jurisdiction with ditching, trees and utility poles.
There is a fence issue on 72nd and Highway A. The fence is in the County right of way and too close to the road. Mr. Voigt stated that he thought because the Town of Maine took care of this section on 72nd, that we would take care of how far her fence went out in the town right of way.
Chair Hoenisch explained that we’re working with the DOT on N. 4th Avenue and they’re not making us clear every tree in the right of way and they’re not making us ditch, and this is to get $200,000.00 from the state. She explained that when she spoke with the Town’s Association, she

didn’t get info like Mr. Sala got. She was concerned about how you handle the maintenance, how you handle reconstruction; we weren’t talking about building a road to now what the state considers spec. We were just talking about doing maintenance or resurfacing. We need to sit down and start from scratch on agreements for this shared road. Mr. Voigt stated that when they did the north part of 72nd, there were no problems. Attorney Frokjer explained that we’re just now getting complaints from residents on our side of 72nd regarding moving big trees and utility poles.
Mr. Sala proposed to the Town of Maine that they would reconstruct this road, make it a 4 rod road, remove the trees, proper ditching and re-blacktop it after 1 year at Berlin’s cost. No cost to Maine. He wants to know what the big disagreement is, if they construct a road to the state’s standards.
Supervisor Schult said that if you do ditches like you did on Naugart that were 4’ deep and you get a car going off of there, it will roll into the ditch. He see’s no necessity to it. Chair Hoenisch explained that when Mr. Sala came into the office, he had stated that if you didn’t get cooperation from Maine for 72nd Avenue, then the road would remain gravel. Supervisor Schult stated that when the Town of Maine Board went out and looked at the south mile of 72nd, there are a lot of issues with road right of way and graves. Supervisor Schult asked what is going to be done with the two homes right next to the road, by the Highway A intersection. He stated that if this road was re-done, 72nd would have to be narrowed by these homes. Supervisor Schult asked that why in the middle of nowhere, is it a necessity to move telephone poles and power line poles. Mr. Schult explained that in front of Krueger’s home, that is the highest point in the road. Mr. Sala said drainage is 90% of building a proper road and you need to start by Krueger’s and get the water to go both ways. Mr. Schult said you don’t need such big ditches. Jim Sala said it needs to be constructed to a proper ditch line, which means feathering them out; but then you could be into the roots of the trees and then they would die. Much discussion followed about possibilities for this road.
Motion by Supervisor Schoepke to adjourn at 9:15 p.m., seconded by Supervisor Schult. Motion carried.
