Town of Maine Special Board Meeting
A Special Meeting was held at the Town of Maine Town Hall on Monday, July 23, 2007 at 1:00 p.m. regarding the DNR public hearing on the Van Der Geest Dairy Cattle Air Pollution Control Permit.
Chairperson Hoenisch called the Special Board meeting to order at 1:00 p.m.
Present were Town Board members Chairperson Betty Hoenisch, Clerk Tammi Walter, Supervisor Tad Schult, Supervisor Sue Shore, Treasurer Marilyn Grunenwald and Attorney Randy Frokjer.
Chair Hoenisch explained that the meeting had been called to allow the Town Board an opportunity to discuss a possible statement that the Town should make at the July 24th DNR public hearing for the Van Der Geest Dairy Cattle Air Pollution Control Permit.
Discussion followed regarding the Town’s ordinances on odors and pollution. The Town Board members had questions for Attorney Frokjer regarding the Town’s possible liability issues, should there be pollutants that the DNR has not tested for that may be causing the health problems that residents seem to be experiencing.
Attorney Frokjer stated that the Town does not want to get involved unless the DNR does not remedy the potential problems. To enforce our ordinances would cost the taxpayers a lot of money. The Town should encourage the DNR to do their job to determine what additional testing needs to be done, what chemicals to test for and what type of changes may be needed to eliminate the haze and odor that the residents are troubled by.
Attorney Frokjer passed out a resolution that was very neutral but stated that the Town would like a fair balance between the agriculture interests and the neighboring Town residents. The Town Board reviewed the resolution.
Chair Hoenisch called for a motion. Supervisor Schult made the motion to approve the attached resolution, seconded by Supervisor Shore. Attorney Frokjer stated that he will e-mail the resolution to Steve Dunn at the DNR so that he has a chance to review it before the public hearing.
Supervisor Schult, seconded by Supervisor Shore to adjourn the meeting at 2:10 p.m.
