The Regular Meeting of the Board of Supervisors for the Town of Maine was held at 6:30 p.m. Monday, February 7, 2005 in the Town Hall, 6111 North 44th Avenue, Wausau, WI 54401.
Agenda for this meeting was posted on February 4, 2005 at the Chapter Two Restaurant, Northside Citgo, Richard’s Supper Club, Schmidt’s Bar and the Town Hall.
Present were Chairman Utecht, Supervisors Duane Grunenwald and Marty Zernicke, Clerk Betty Hoenisch, Atty. Byll Hess and community members.
Chairman Utecht called the meeting to order at 6:30.
The Board of Supervisors reviewed the accounts payable bills.
Chairman Utecht asked the audience to stand for the Pledge of Allegiance to the flag.
Chairman Utecht called for a motion to approve the accounts payable bills that were presented. Mr. Zernicke made a motion to approve the bills presented, seconded by Mr. Grunenwald. Motion carried.
The clerk read the minutes of the January 10, 2005 Board of Supervisor meeting. Mr. Zernicke made a motion to approve minutes as read, seconded by Mr. Grunenwald. Motion carried.
The clerk read the minutes of the January 11, 2005 Town Caucus. Mr. Zernicke made a motion to approve minutes as read, seconded by Mr. Grunenwald. Motion carried.
The clerk explained that Treasurer Marilyn Grunenwald was attending her son’s birthday and read the treasurer’s report. The January 31, 2005 Money Market account balance was $1,363,582.52, the checking account balance was $2,717.74 and the Garbage / Recycling CD balance was $1,000.00. The January 31, 2005 Fire Department petty cash checking account balance was $2,311.55 and the Fire Department Money Market for memorials and special donations was $9,823.86. Mr. Zernicke made a motion to approve the treasurer's report as read, seconded by Mr. Grunenwald. Motion carried.
Zoning Administrator Robert Christensen reported that he had issued a zoning permit to James Hase for a new home at 1400 N. 36th Avenue and expects to have the building permit application for that home in the near future.

Chairman Utecht stated that the first item of business was presentation and discussion on the 28th Avenue corridor map.
Marathon Highway Commissioner Glen Speich was present and explained that maps had been sent out to the Town Board for review. Mr. Speich reported that the mailing list for the corridor meetings is up to 500 and those people had the opportunity to comment on the corridor map at the last meeting at Highland Community Church and there were very few questions. There is some controversy on the road from Apple Lane south, however there has been almost no controversy on the corridor segment north of Apple Lane. Mr. Speich explained that he was here to answer any final questions and get the Town’s approval on the corridor map.

Atty. Hess stated that the map was only on the agenda for discussion so no action could be taken tonight. The clerk stated that she could post this item on the February 16th Special Board Meeting for approval. Atty. Hess also stated that Mr. Speich should be invited to attend a zoning meeting to help the Town plan the setbacks for the corridor.
Mr. Speich explained that the corridor map takes all access control away from the Town. The county is looking to control access especially driveways and when a town road is proposed the county will work with the developers, the Town and the Plan Commission to approve road applications. The Town or developers will need to show a dedicated road right of way to the county on their development maps. Mr. Speich also explained that there would be a study done starting in 2005 or early 2006 to connect 28th Avenue to 41st Street with a new bridge crossing the Wisconsin River between Decator Drive and Hwy WW. Mr. Speich stated that he would be delivering a large set of the aerial maps to the Town.
Chairman Utecht stated that the next item of business was discussion and possible action to approve the William Carazalla permits. Atty. Hess explained that there was a request for a building permit for a house on lot 12 by William Carazalla. The Carazalla’s road agreement states that if any lots were sold or any building permits requested the Carazalla’s would pave the north half of the subdivision roads and the Town would pave the south half of the roads. Atty. Hess stated the Town had not budgeted at present time to pave their portion of the subdivision road and the residents are not complaining so the paving can be delayed at this time. Atty. Hess stated that it is not necessary to amend the road agreement but the building permits need to be approved. Mr. Zernicke made a motion to approve resolution 2005 – 004 to approve the Carazalla permits, seconded by Mr. Grunenwald. Motion carried.
Chairman Utecht asked if there was any discussion from the audience. Mike Wanke was present and stated that there had been a Board of Appeals public hearing on January 19, 2005 to hear his request for a residential business compliance statement and that he was suppose to be notified of that decision in 15 days and he has not received letter of compliance yet.
Atty. Hess stated that they have not received the Board of Zoning Appeals opinion and Mr. Wanke questioned if the law firm had not received the transcript. Atty. Hess stated that they had received the transcript but the Board of Appeals was preparing a summary of their decision.
Mr. Wanke questioned who was preparing the summary because Burnell Utecht had left for a two-month vacation shortly after the public hearing.
Atty. Hess stated that the Town Board has 30 days to decide if they are accepting or appealing the Board of Appeals decision and the Town Board is having a closed meeting on February 16, 2005 with legal counsel to review this matter.
Dennis Wanke questioned why it was a closed meeting and stated that he felt it should be an open meeting. Atty. Hess explained that the decision would be at an open meeting but the Town has the right to confer with legal counsel to discuss their rights and options regarding the case in a closed session.

Chairman Utecht stated that the Town had not received a letter from the Board of Appeals regarding their decision and that Burnell Utecht had never contacted him regarding the public hearing or the Board of Appeals decision.
Atty. Hess explained that nothing could be decided at the meeting tonight, but that they would check to see if they could eliminate the written opinion and try to substitute the transcript for the Board of Appeals decision.
Next meeting will be Monday, March 14, 2005 with Bill Approval at 6:30 p.m. and General Business at 7:30 p.m.
Mr. Zernicke, made a motion to adjourn at 7:53 p.m., seconded by Mr.Grunenwald. Motion carried.
