February 16, 2005
A Special Meeting of the Board of Supervisors for the Town of Maine was held at 8:00 a.m. Wednesday, February 16, 2005, in the Town Hall, 6111 North 44th Avenue, Wausau, WI 54401.
Agenda for this meeting was posted on February 11, 2005 at the Chapter Two Restaurant, Northside Citgo, Richard’s Supper Club, Schmidt’s Bar and the Town Hall.
Present were Chairman Utecht, Supervisors Duane Grunenwald and Marty Zernicke, Treasurer Marilyn Grunenwald, Clerk Betty Hoenisch, Atty. Tom Brunner and Atty. Bob Reinertson.
Chairman Utecht called the meeting to order at 8:12 a.m.
Chairman Utecht stated the approval of the 28th Avenue Corridor map was the first item of business. Glen Speich was present and stated that the City of Wausau and the Town of Stettin have passed a resolution approving the corridor map. Questions followed regarding the hill, utilities, driveway access and the number of homes being affected. Mr. Speich stated that 28th Avenue would end with a cul de sac by Mary Ann Lane to allow access to the homes and there would only be a walking trail south from the cul de sac to the bottom of the hill. Mr. Speich also stated that only 3 homes were affected and the cost to purchase the corridor today would be $800,000.00. Mr. Zernicke made a motion to approve resolution no. 2005 – 005 approving the 28th Avenue Corridor Map, seconded by Mr. Grunenwald. Motion carried. Chairman Utecht called for a motion to go into closed session to confer with legal counsel on the Wanke matter. Mr. Zernicke made a motion to go into closed session, seconded by Mr. Grunenwald. Motion carried.
Mr. Zernicke made a motion to adjourn the closed session and return to open session, seconded by Mr. Grunenwald. Motion carried.
Chairman Utecht called for a motion regarding the Wanke’s matter. Mr. Zernicke made a motion for the Town Board to file an appeal to preserve its appeals rights with the intent to delay action with the Wanke’s cooperation. In the meantime the Town will work on the zoning ordinance to include the type of business the Wanke’s wish to operate in the zoning conditional uses. After the conditional uses are amended then the Wanke’s will need to come before the Plan Commission with a conditional use petition, seconded by Mr. Grunenwald,. Motion carried.
Dennis and Michael Wanke were asked to join the open session and the clerk read the motion made by Mr. Zernicke and seconded by Mr. Grunenwald.
The Wanke’s had questions on the conditional use petition process, timeline for the process and if the conditions would be the same conditions that the Board of Appeals had set. Atty. Brunner stated that the Town would petition for the amendment to the zoning ordinance, a public hearing would be held at the March 7, 2005 Plan Commission and the Town Board would hear the Plan Commission’s recommendation at the March 14, 2005 Board Meeting. If the zoning ordinance amendment was approved the Wanke’s could then submit their petition for a conditional use.

Special Board Meeting
Michael Wanke stated that he would like to talk with his advisor Mr. Karaken and would bring his decision back to the supervisors. The Wanke’s asked what would happen if they decided not to go for a conditional use and Atty. Brunner stated that the case would then go to Circuit Court.
Mr. Grunenwald made a motion to adjourn the meeting at 10:10 a.m., seconded by Mr. Utecht.
