December 12, 2005 Type of meeting: Regular

Minutes:
 
Chair Hoenisch called the Board of Supervisors meeting to order at 5:30 p.m.
 
Accounts payables were reviewed.
 
Chair Hoenisch explained the 2%Budget levy imposed by Governor Doyle, she distributed the four different proposals that Clerk Freund and herself had drafted and requested that the Town Board Members review them for the November 16, 2005 Public Hearing.
 
The Board met with Cory and Dick from IROW in regards to the increase they are requesting due to the price increase of diesel fuel. This will be decided on at a special meeting at a later date.
 
Chair Hoenisch welcomed the residents and asked them to invite their friends and neighbors attend the Public Budget Meeting on Wednesday, November 16, 2005.
 
The Pledge of Allegiance was recited.
 
Supervisor Zernicke made a motion to accept bill payables, seconded by Supervisor Wanke, motion carried.
             
 
 
 
 
November 14, 2005
 
Chair Hoenisch requested to dispense of the reading of the minutes and approve them. Supervisor  Wanke  made that motion, seconded by Supervisor  Zernicke ,Motion carried.
 
Chair Hoenisch reported on the floor finishing of the Town Hall and the improvement is great.
 
Supervisor’s Report:  Supervisor Wanke didn’t have anything to report.  Supervisor Zernicke reported there are roads they are monitoring.
 
Treasurer’s Report:
Marilyn Grunenwald reported on the balances of the Town of Maine Accounts:

Supervisor Wanke made a motion to accept the treasurer’s report, seconded by Supervisor Zernicke, Motion carried.
 
Zoning Administrator’s Report: Bob Christiansen could not attend tonight’s meeting.
 
Other Business:
 
A. IROW has requested a $2.50 per household increase due to the increase of diesel fuel.  The Town does not want to amend the present contract but would like to increase the fee per household $1.00 as a possible surcharge.  Attorney Frokjer stated that the Town could apply a surcharge without affecting the contract. Supervisor Wanke made a motion to table this issue until the Public Hearing on Wednesday, November 16, 2005. Seconded by Supervisor Zernicke, motion carried.
B. Chair Hoenisch explained the 3% increase for Berlin, Brokaw and a portion of Stettin that the Town of Maine provides emergency services to. Supervisor Wanke made a motion to approve a 3 % increase due the Town, for each township, Supervisor Zernicke seconded, motion carried.
C. Chair Hoenisch explained that Mr. Forenza who purchased land from Mr. Lonsdorf has asked for permission to begin construction of his house. Chair Hoenisch suggested that the Board authorize the building inspector to issue a start construction permit which would allow Mr. Forenza to complete his foundation footings and foundations only at this time. Supervisor Zernicke made a motion to authorize Bob Christensen to issue the start construction permit, seconded by Supervisor Wanke. Motion carried.
D. Attorney Frokjer suggested not to dedicate Julian Drive as a Town Road in the Lonsdorf subdivision until the road is up to specs and work is complete. Supervisor Zernicke made a motion to table this issue until the December 12, 2005 meeting, seconded by Supervisor Wanke, Motion carried.
E. Attorney Frokjer explained that Mr. Lonsdorf’s $20,000  letter of credit is like a line of credit, no interest is incrude. Supervisor Zernicke made a  motion to table this issue until the December 12, 2005  meeting, Seconded by Supervisor Wanke, motion carried.
 
      F. Chair Hoenisch explained that Mr. Roets came to the Town Office and asked for an extension until December 30, 2005 for the grinding of the cement. Mr. Roets brought Mr. Martin and met with the Board as a special meeting to accommodate Mr. Roets. Attorney Frokjer stated that the judge would more than likely not have an issue with this civil case. Supervisor Wanke made a motion to modify the injunction, seconded by Supervisor Zernicke, motion carried. Supervisor Wanke amended the motion stating to allow the extension of crushing  until December 31, 2005, Supervisor Zernicke seconded the motion, motion carried.  
 
               G.  There are two ways to proceed with the Narlock property, one being uninhabitable or a public nuisance. If it is deemed a public nuisance the party could still live in the residence or uninhabitable where they could not until the building is brought up to code.
Attorney Frokjer suggested that the Town Board have a contractor issue a repair estimate. Attorney Frokjer stated that you could post these findings and require all items be fixed and repaired before inhabitation. A new owner will also have to comply with the findings.
Supervisor Wanke made a motion to serve the proper paperwork and make this property inhabitable and request repairs be made within 60 days or further action will be taken by the Town and possible razing of the structure according to laws of WI., seconded by Supervisor Zernicke, motion carried.
 
               H. Attorney Frokjer stated that the zoning ordinance has a special section on zoning ordinance’s amendments. The Plan Commission would need to hold a public hearing, then make a recommendation to the Town Board at their December meeting and the Board would need to approve a  resolution deleting the zoning compliance statement. It is not addressed in case law replied Attorney Frokjer and he also noted that he has spoken with Attorney Shane Vanderwale who questioned why the Town of Maine even had a compliance statement in their zoning ordinance. Attorney Vanderwale is representing the Town of Maine Board of Appeals in the Wanke case.
Marty Zernicke made a motion to approve the resolution to remove  the compliance statement from the Town of Maine zoning ordinances.  Supervisor Wanke was not willing to seconded the motion, Chair Hoenisch seconded the motion, motion carried.  
 
 
              I.  Supervisor Wanke made a motion to accept the Krause Howard and Company 2005 year end audit contract agreement, seconded by Zernicke, motion carried.
 
              J.  Supervisor Zernicke  made a motion to accept the Erdman Land Lease agreement at the present rate, seconded by Supervisor Wanke, motion carried.
 
November 14, 2005
 
               K. Chair Hoenisch explained the road maintenance agreement and that the Town Board plows half of Falcon and a portion 32nd Avenue. Supervisor  Wanke made a motion to raise the road maintenance agreement  with Brokaw to $1600.00 for 2006, seconded by Supervisor Zernicke, motion carried. 
 
Open Discussion from audience:
 
 A resident asked if the Narlock property can be tested further, Attorney Frokjer stated that it could not. Another resident asked if the Chairperson could get a raise, Chair Hoenisch explained that wages cannot be changed until the November 2006 budget public hearing. Wages are set at that time for the next term of office.
 
 At 9:07 p.m. Supervisor Zernicke made a motion to adjourn, seconded by Supervisor Wanke, Motion carried.
 
The next Board of Supervisors meeting will be December 12, 2005 with bill payables at 6:30 and the general meeting at 7:30 p.m.
