Closed and Special Board Meeting

The meeting was called to order 11:00 a.m. by Chair Hoenisch
Present were Chair Hoenisch, Supervisors Wanke and Zernicke, Clerk Kimberly Freund Treasurer Marilyn Grunenwald and Attorney Randy Frokjer.
Chair Hoenisch requested a motion to convene into closed session pursuant to State Statute 19.85(1)(g) for the purpose of conferring with legal counsel for advice concerning strategy to be adopted with respect to litigation or possible litigation in which the Town is or is likely to become involved.
Supervisor Zernicke made that motion, seconded by Supervisor Wanke. Motion carried.
Discussion about the Settlement Agreement for the Dennis and Michael Wanke case took place.
Discussion about the possible dismissal of the Town of Maine verses the Town of Maine Board of Appeals case took place.
Chair Hoenisch requested a motion to adjourn the closed session. Supervisor Zernicke made that motion, seconded by Supervisor Wanke. Motion Carried.
Chair Hoenisch requested a motion to reconvene into open session at 12:29 p.m. ,Supervisor Wanke made that motion, seconded by Supervisor Zernicke. Motion carried.
Supervisor Zernicke made a motion to submit a proposal to adjourn or stay the Town of Maine vs. the Town of Maine Board of Appeals litigation at this time with the following conditions: 1. the Town will not take any action against the Wankes, including citations or injunctions. 2. The Town would make a good faith effort to revise the Town’s zoning ordinances to address not only Mr. Wanke’s issue, but other similar situations to bring other residents into compliance. 3. If Mr. Wanke is not satisfied with the final resolution, he or any other party to the action can proceed with the case, seconded by Chair Hoenisch. Motion carried.
Supervisor Wanke abstained from discussion and voting due to conflict of interest in regards to the Wanke case.
Item B:
Supervisor Zernicke made a motion to not dismiss the Wanke case at this time until it’s resolved, seconded by Chair Hoenisch. Motion carried.
Supervisor Wanke and Chair Hoenisch traveled to N. 60th Avenue and Lincoln Drive to check roads and culverts.
Adjournment was at 2:00 p.m.
