The Board of Supervisors of the Town of Maine will hold a special meeting on Friday, August 15, 2008.

Agenda

1. Call meeting to order at 7:00 a.m. at the Town Hall – Betty Hoenisch, Chairperson
2. Travel to Shoreline Drive.
3. Meet with Scaffidi’s regarding cul de sac, road right of way and fence issues.
4. Travel back to Town Hall.
5. Adjournment.

Special Board of Supervisor Meeting


Chair Hoenisch called the special meeting to order at 7:20 a.m. on Shoreline Drive.

Present were Chair Hoenisch, Supervisor Shore, Supervisor Schult, Sam Scaffidi and public works employees John Marquardt and Scott Cyzan.

Chair Hoenisch distributed a packet that contained copies of Dean McDonald’s road agreement for the portion of Shoreline Drive that is south of Rainbow Drive and copies of Mr. Scaffidi’s easement documents.

Mr. Scaffidi explained that he purchased his land from Dean McDonald and the CSM of the property was recorded December 30, 1999. Mr. Scaffidi said that the Town’s 1998 road agreement with Mr. McDonald did not get recorded until January 19, 2000, which is why he was unaware of the cul de sac that was supposed to be created by Mr. McDonald in 1998.

Chair Hoenisch explained that she faxed Mr. Scaffidi’s CSM to Attorney Frokjer to review. His legal opinion is that the cul de sac showed on Scaffidi’s CSM, so even though the McDonald road agreement did not get recorded until after Mr. Scaffidi purchased his property, the road agreement is still valid.

Becky VanDenHeuvel came out of her home and asked the group if they wanted to view the aerial picture of their property. The picture showed Shoreline Drive with a small sand covered cul de sac at the south end. It also showed the pile of top soil that had been removed from the cul de sac area. She said that the cul de sac eventually got covered with top soil and seeded with grass.

Chair Hoenisch explained that she has spoken to a former road worker Bill Kollath and he confirmed that the cul de sac had never been built properly. Mr. Kollath stated that he either backed all the way to Rainbow Drive or turned the plow truck around in the ditch which was very flat.

Mr. Scaffidi explained the fence and cul de sac issues and made suggestion to rectify the situation.

Chair Hoenisch explained that the Town was revising its cul de sac designs to give the Town options when building cul de sacs on the current 39 dead end roads in the township. Discussion followed on a hammer head type cul de sac and a L-shaped cul de sac verses the conventional round cul de sac that would not work at the end of Shoreline Drive due to the fence Mr. Scaffidi already installed.

Mr. Scaffidi provided a quad axle dump truck to be used to measure the width and length needed for a hammer head cul de sac at the south end of Shoreline Drive.

The group discussed the types of materials to be used and cul de sac construction methods.

The road top was measured to survey markers and it was determined that Shoreline Drive was not centered in the road right of way. The survey markers were also located at the corner of Rainbow Drive and Shoreline Drive which has a road right
of way of 82 feet. Discussion followed regarding the possibility of vacating a portion of the road right of way to a normal 66 feet. Mr. Scaffidi stated he would pay for the survey if the Town would deed the additional land to him because that would save moving some of his fence.

Chair Hoenisch and Supervisor Schult spoke to Terry and Becky VanDenHeuvel regarding their concerns on the location of Mr. Scaffidi’s fence, snow banks, spring drainage and the proposed cul du sac for the plow truck to turn around.

Discussion followed with Mr. Scaffidi that the Town Board preferred he move the portion of his fence that currently is in town road right of way. The Board was concerned that if the fence was not moved a bad precedence will be set that may cause future problems. Mr. Scaffidi said he was happy to cooperate because he understands what position the Town is in and does not want to create trouble for the Board.

Supervisor Schult made a motion to adjourn at 8:55 a.m., seconded by Supervisor Shore. Motion carried.
