The Board of Supervisors of the Town of Maine will hold a regular monthly meeting at the Maine Town Hall on Monday, August 13, 2007.  Accounts Payable will be reviewed at 6:00 p.m. with General Business at 7:30 p.m.
  
Minutes:
 Chair Hoenisch called the meeting to order at 6:00 p.m.
 The Supervisors reviewed the bills payable.
 The Pledge of Allegiance was recited.
 Chair Hoenisch explained to the audience that the meeting had been called at 6:00 to allow time for a zoning project review with the Zoning Administrator and Attorney Frokjer.
 Chair Hoenisch requested a motion to approve bills payable.
Supervisor Schult made a motion to approve bills payable, seconded by Supervisor Shore. Motion carried. 
 Clerk Walter stated that she has July 9th, July 23rd and August 3rd meeting minutes that will need to be approved.  Chair Hoenisch asked the Supervisors to make a motion to dispense of the reading of the minutes and make any changes or corrections.  No corrections were made.  Supervisor Shore made a motion to approve the minutes, seconded by Supervisor Schult. Motion carried.
 Chairperson’s report:
 Chair Hoenisch reported that she had worked with John Bangart, Supervisor of the Stratford Division of Marathon County Highway Department. They worked on lane wedging 28th Avenue from County Road U to Merrill Avenue, 60th Avenue from County Road A to Lincoln Drive and Naugart Drive from County Road K to North 28th Avenue. They are also looking at chip sealing the entire road, hoping to get another 15 years out of the pavement using this method.
Chair Hoenisch reported that she worked with John Bangart on the Rainbow Drive large culvert installation projects. Marathon County is trying to keep the large excavating machine they rent for the summer and their crew busy, so they are giving Town’s a great price for these services.  
 Chair Hoenisch reported that the Town purchased large culverts at cost plus a handling fee from Lincoln County at a lower price than they can be purchased from other suppliers.  
 Chair Hoenisch worked with John Reif from Bergman Company and they have selected the roads that will be crack sealed this summer. There are a lot of cracks to be sealed but crack sealing is great preventive maintenance.
Chair Hoenisch reported that Supervisor Schult, workers and she have been working with Lee Van Der Geest on his road off of County Road K. They have dug test holes, and requested additional rock to level the road and some additional culvert work. This road will be ready to pave in 2008.
   Chair Hoenisch reported that the Plan Commission on August 6th approved a conditional use permit for a residential business for Brent and Marcie Solum at 3720 N. 60th Avenue. They will be operating a semi dispatch business out of their accessory building.
 Supervisor’s report:
 Supervisor Shore reported that she had issued 1 fire permit.
 Supervisor Shore reported that she had attended a DNR public hearing on July 24th at the NTC regarding the new NR115 regulations which will affect people that own property along Wisconsin waterways. She was quite concerned about some of the new regulations that the DNR is trying to propose. Supervisor Shore invited people to come to her after the meeting for handouts on NR115.  
 Supervisor Shore reported that on August 6th on WSAU radio 550, Jack Schneider had his final program about Smart Growth.  Jay Verhulst, Michael Kaufman and she had participated on one of Jack Schneider’s three panels.
 Supervisor Shore reported that on July 26th some of the Board members attended the Eastern / Western Towns Association meeting at Rib River Ballroom.  Very good meeting with information on the proposed legislation to delay the adoption of the Comprehensive Plan from 2010 to 2015.  There may be an exemption that would allow municipalities under 2500 not to have to adopt a plan.  Information on emergency training for officials and radio grants had also been presented at the meeting. 
 Supervisor Shore reported that she will be going to the National Township Association Meeting September 5th and 6th in Washington DC.  She will bring information back from that meeting.
 Supervisor Schult reported that he worked with the road workers on the Rainbow Drive culvert installations.
 Supervisor Schult reported that he went and viewed a road in the Town of Johnson, west of Highway 97 that had been lane wedged and chip sealed. This may be something we will do in the future.
 Supervisor Schult reported that he had worked with a Tree Company to remove a rotted oak tree that was in the Town’s right away on North 28th Ave. in front of the Rasmussen house. Chair Hoenisch stated that Rasmussen’s had called and were very pleased with the tree removal.  They said their yard had been left so clean that if the tree wasn’t gone they would not have known someone had been there.
 
Treasurer’s Report:  Marilyn Grunenwald reported on the Town’s bank accounts ending July 31, 2007:

Supervisor  Shore made a motion to approve the Treasurer’s report, seconded by Supervisor  Schult. Motion carried.
Zoning Report for July 2007- Zoning Administrator Rich Grefe reported that he had issued eight permits and completed fifteen inspections in the month of July. 
 Other Business:
A.   Discussion and possible action on the John Kent and Asif Yusif petition to rezone a parcel at the SE corner of Decator Drive and North 20th Avenue from R-1 Suburban Residential Single Family to BP – Business Park.  
 Chair Hoenisch explained that this item had been on the August 6th Plan Commission meeting. There had also been a public hearing for the petition held that evening. There had been many comments from the neighbors that they did not want this property rezoned to Business Park.  The Plan Commission after much deliberation made a motion to recommend that the Town Board approve the rezoning petition. Chair Hoenisch read a letter from Mr. Kent dated August 10, 2007.  In that letter Mr. Kent stated that due to the concerns from neighbors at the August 6th Plan Commission meeting he will make the development not only functional, but aesthetically pleasing to mitigate any potential impact on adjacent property owners.  The letter stated that he will consider the use of landscaping for a visual buffer in addition to directional security and yard lighting.
 Chair Hoenisch introduced Patrick Chrouser, personal representative for Mr. Kent. 
Mr. Chrouser did a brief presentation on Mr. Kent’s plan for developing the property.  He offered to answer questions from neighboring property owners.Many neighbors had comments similar to their comments at the August 6th Public Hearing and Plan Commission meeting.  The neighbors prefer that the land not be rezoned.  If it were to be developed they would like residential properties.
Chair Hoenisch read a letter from Colleen and Pete Santeford stating that they could not be present but are voting to not have the land rezoned.
Chair Hoenisch explained that there are only three options. Option 1-is for the developer to do a direct petition for annexation to the City of Wausau. The City will then rezone the land to Business Park.  Rosemurgy’s and Saturn’s land were once the Town of Maine.  Since those properties which the City has already rezoned are adjacent to this land, the City will be glad to annex and rezone this land to Business Park. If this land goes to the City, neighbors will have no say and it will leave their properties more vulnerable to annexation.
Option 2-is for the Town to rezone this property to Business Park which will allow the neighbors and Plan Commission the ability to work with the developer on lighting, landscaping and buffer issues.  Keeping the land in the Town of Maine also helps increase the tax base which is beneficial to all residents.
Option 3-is for the neighbors to cooperatively purchase this land and keep it green.
Attorney Frokjer explained to the audience that this is an opportunity for the Town to work with the developer, increase its tax base, protect and create a buffer on its boundary.  He explained that the Town’s border at one time touched Stettin and Wausau on the corner by Marathon Park.  The Town boundary went east to the Wisconsin River by the East Bay facility.  This is how much of Maine that has been taken thru annexation.  Rezoning this parcel and keeping it in Maine is a great way to try to prevent further loss of Town land.
More comments followed by concerned residents stating that basically they just want the land to remain the same.   
Pat Chrouser stated that they were working with Urban Construction on their business plan and hopes to start building within the next six months.  Later they plan on coming to the Town with their Plan Unit Development for the land south of this property, which they would also like to keep in the Town.  He stated that if the Town won’t rezone the land, they will take their development to the City.
Dennis Wanke stated that he had spoken with Joe Gehin, Wausau’s Director of Public Works.  Mr. Gehin told him that Wausau is not interested in annexing this land.
Chair Hoenisch, Supervisors Schult and Shore explained what had transpired in their meetings with the City of Wausau regarding the Brokaw water line and other annexation issues.  They explained how they have tried to get cooperation on these issues with no success.  Chair Hoenisch said she attended Wausau’s public hearings on the Cassidy Drive development and the 20th Avenue road issues where the property owners concerns were never taken into consideration by the City.
Judy Bayba explained that she has attended many City public hearings where an entire neighborhood was against a project and the Council would still vote to approve the petition.  If this land goes to the City the neighbors will not have any control over what happens on the property.
After more discussion Supervisor Schult explained that he understood the neighbors concerns, however rezoning the land, keeping the tax base, and protecting our boundaries are what will benefit the entire Town.  He asked the residents to attend meetings and help with the business plan approval for the proposed project.
Supervisor Shore explained that her heart went out to the neighbors and she understands their concerns.  She said she loves this township and wants to save it from annexation.  Rezoning this property will help save the township.
Supervisor Schult made a motion to rezone this land to BP – Business Park and have the Plan Commission approve the business plan with conditions that are suitable to neighboring properties, seconded by Supervisor Shore. Motion carried.             
B.   Discussion and possible action on a resolution to vacate un-built roads in the Assessor’s Plat #1 subdivision. This was the Town’s very first subdivision. Got copies of all CSM’s in that subdivision which lead Chair Hoenisch to believe that the road areas shown on the maps belong to the Town. Chair Hoenisch hired a title search company and they confirmed it. Chair Hoenisch couldn’t get all the people involved in this together for a meeting.
Chair Hoenisch decided to table this item till next month because all parties involved couldn’t attend tonight.     
C.   Discussion and possible action to schedule the curb side large item cleanup.  It is tentatively scheduled for August 27th, 28th, 29th and 30th for all items except appliances, tv’s and computers. These items need to be paid for in advance.  Chairperson and Clerk will take payments, issue stickers and compile a list for Mr. Reed.  The large item cleanup that requires a fee will be the week of September 24th.  
Supervisor Shore made a motion to schedule this large item cleanup,
     seconded by Supervisor Schult. Motion carried.
          Open discussion from audience without action by the Town Board – There was none.                                    
The next Board of Supervisor’s Meeting will be September 10, 2007 at 7:30p.m.                                                                                                                                                                                                        
Motion by Supervisor Schult, seconded by Supervisor Shore to adjourn the meeting at 10:27 p.m.
