The Board of Supervisors of the Town of Maine will hold a regular monthly meeting at the Maine Town Hall on Monday, August 10, 2009. Accounts Payable will be reviewed at 6:00 p.m. with General Business at 7:30 p.m.

Board of Supervisors Meeting



Minutes:

Chair Hoenisch called the meeting to order at 6:00 p.m.

The Pledge of Allegiance was recited.

Chair Hoenisch requested a motion to approve bills payable. Supervisor Schult made a motion to approve bills payable, seconded by Supervisor Schoepke. Motion carried.

Clerk Walter explained that she has July 13, July 20, July 27, and August 3, 2009 meeting minutes that will need to be approved. Chair Hoenisch asked the Supervisors to make a motion to dispense of the reading of the minutes and make any changes or corrections. Supervisor Schult made a motion to approve the minutes, seconded by Supervisor Schoepke. Motion carried.

Chairperson’s report:

Chair Hoenisch reported that the Board has been really busy working on Town roads, working on culverts, working on cul de sacs and working with residents on ditch issues. She also gave an update on the N. 4th Avenue road project with 3M.

Supervisor’s report:

Supervisor Schult reported that the Town put rock on N. 4th Avenue and packed very nice. He explained that he had gotten a hold of 3M and they agreed to help us water N. 4th Avenue.

Supervisor Schult reported that he’s been working on the path for Saber Drive residents, for when their road is closed.

Supervisor Schoepke reported that the water tank is finished and all set for watering roads.

Supervisor Schoepke reported that he’s been working on the clean up issue in the yard waste site.


Treasurer’s Report: Treasurer Marilyn Grunenwald reported on the Town’s bank accounts ending July 31, 2009:

Supervisor Schoepke made a motion to approve the Treasurer’s report, seconded by Supervisor Schult. Motion carried.


Zoning Report for July 2009 – Zoning Administrator Rich Grefe reported that he had issued two permits and completed thirteen inspections in the month of July.


Other Business:

First item of business was discussion and possible action to approve the note, certificate and resolution for the $400,000.00 N. 4th Avenue road reconstruction project loan. Attorney Swid, who is here representing People’s State Bank, explained that the note is for $400,000.00 with an interest rate of 3.98%. The monthly payments will be $9,042.40 for no more than four years and the Town has the option to prepay without penalty.

Chair Hoenisch explained that the Town went out on this loan for four years and what will happen is the Town will be getting the bill for this road, so then the Town will then take care of it. She explained that it will be a little bit before we get a payment from 3M. We will be getting the 2nd installment in a year, in which we will have to invest to make the payments. She explained that if we would’ve gone out two years on the loan that then the payments would’ve been more than 3M’s payment. When we get the TEA Grant money and money from the City of Wausau, this will all go to paying off the loan. Supervisor Schult made a motion to approve the resolution approving the $400,000.00 3M/4th Avenue road loan, seconded by Supervisor Schoepke. Motion carried.

Next item of business was discussion and possible action on Tetra Tech’s pavement verification testing and inspection services proposal for Rainbow Drive and Brandenburg Avenue. Chair Hoenisch explained that the Supervisors and herself went out this last weekend and viewed the cracks once more and they have closed up quite a bit. She explained that she got an estimate cost of $1940.00 to do core samples.

Supervisor Schult asked Attorney Frokjer that if there was something wrong with these test samples, would that be enough to go after the company that paved these roads. Attorney Frokjer explained we could, but better have some good documentation. Supervisor Schult then asked if these test samples would be enough. Attorney Frokjer said that what he’s seen, it’s been to do something early on or don’t do it. The ones that come later on; not seeing them.

Chair Hoenisch stated that we made RC Pavers aware of the cracks 6 months after paving was completed. Attorney Frokjer’s experience is we’re better off using what ever we have for leverage for the next time this company would do work in our township. Attorney Frokjer stated that we have the ability in our own way, to tell the company to fix it. He’s seen a lot of areas where Towns weren’t happy with the road work that was done and told companies to fix it to our satisfaction or we will deem you non-responsible. This seems to be the leverage that works for other Towns.

Discussion followed about crack filling and then slag sealing for the top. If the cracks are routed and filled then you have a almost new road where all you feel is one bump after another. Attorney Frokjer explained that by what he’s hearing, we can count the number of cracks; we don’t need anyone to do that for us.

If the issue is going to be the material or not using the right mixture, then the road won’t hold up. Road worker, John Marquardt stated that if the mixture isn’t good; we don’t have any specs. The bid stated we wanted an E3.

Chair Hoenisch explained that RC Pavers engineer has the same E3 specs that American Asphalt would’ve given us.

Chair Hoenisch said that when you start at Brandenburg, it is one crack after another. If all of a sudden it cracks between the cracks, that road will literally fall apart in ten years.

Supervisor Schoepke stated that he wants to talk with RC Pavers before we decide to do anything harsh.
Attorney Frokjer said we should meet with RC Pavers and then if we’re not satisfied then, go the other route.

Supervisor Schult asked why we can’t go to the worst crack and take our own test sample. If anything shows up in that sample, then we could go back and do more. He can’t justify the cost if Tetra Tech would do this. Table until we meet with RC Pavers.

Next item of business was discussion and possible action to approve emergency services access agreement with Don Radtke, Brian Fox and Faith Lutheran Church. Chair Hoenisch explained that she called the Town’s Insurance Company and they strongly recommended that the Town only become involved with the affected residents to the degree they are told about the “access deal” with the adjacent landowner. Supervisor Schult made a motion to have Attorney Frokjer draft a “temporary access for emergency services during road construction agreement” between the Town and affected land owners, seconded by Supervisor Schoepke. Motion carried.


Open discussion from the audience.
There was discussion about a shed being built in the township without permits.


Schedule the next Board of Supervisor Meeting for September 14, 2009 at 6:30 p.m. for bill approval and general business at 7:30 p.m.

Motion by Supervisor Schoepke to adjourn at 9:06 p.m., seconded by Supervisor Schult. Motion carried.
