Regular Meeting
The Regular Meeting of the Board of Supervisors for the Town of Maine was held at 7:30 p.m. Monday, April 11, 2005 in the Town Hall, 6111 North 44 th Avenue, Wausau, WI 54401.
Agenda for this meeting was posted on April 8, 2005 at the Chapter Two Restaurant, Northside Citgo, Richard’s Supper Club, Schmidt’s Bar and the Town Hall.
Present were Chairman Utecht, Supervisors Duane Grunenwald and Marty Zernicke, Clerk Betty Hoenisch, Atty. Byll Hess and several community members.
Chairman Utecht called the meeting to order at 7:33 p.m.
The Board of Supervisors reviewed the accounts payable bills.
Chairman Utecht asked the audience to stand for the Pledge of Allegiance to the flag
Chairman Utecht called for a motion to approve the accounts payable bills that were presented. Mr. Zernicke made a motion to approve the bills presented, seconded by Mr. Grunenwald. Motion carried.
The clerk read the minutes of the March, 2005 Board of Supervisor meeting. Mr. Zernicke made
a motion to approve minutes as read, seconded by Mr. Grunenwald. Motion carried .
Chairman Utecht said to skip the chairman’s report.
Treasurer Marilyn Grunenwald read the treasurer’s report. There were no corrections or additions, Mr. Zernicke made a motion to approve the report presented, seconded by Mr. Grunenwald.
Other business proceeded. Chairman Utecht read the sealed bids for road work, the bid will be decided on April 18, 2005.
Tom Cortright has the insurance needed for the antique car show, Compass Insurance Company will be insuring the property that day. The form was not faxed to the town hall but he has the phone numbers to confirm. He said he has permission to park at Maine School for parking overflow. There will no parking on Hwy. K. Attorney Hess suggested getting paper signs from the county and post them prior to the show. There is no charge to attend the car show. A local restaurant will have concessions for the day. A local radio station will be there also. All was in order. Motion to approve by Mr. Zernicke and seconded by Mr. Grunenwald. Motion carried.
Chairman Utecht called for a motion to appoint Ed Bohte, Deb Klopp and Mark Stubbe to another term on the plan commision from May 2005 to May 2008. Marty Zernicke made a motion to approve and Duane Grunenwald seconded the motion. Motion carried.
Chairman Utecht asked if their were any questions from the audience at this time.
Don Schnelle brought up a blacktop situation. The resident was under the impression from Atty. Hess that you have to have a number of cars go by in order to get the black top. Atty. Hess didn’t mean to give that impression. Atty. Hess explained that there are several things that go into making that decision. Chaiman Utecht said the blacktop is scheduled for 2006, for now it will be granite.
Steve Miller, a resident, asked if the road would be graded first to get bumps and soft spots out and that if this was a procedure to prepare the road for blacktop. Chairman Utecht said yes. Along with the ditches and culverts that would be repaired if necessary too. This is a process. This matter will not be decided here this evening replied Chairman Utect. The new board will have to decide.
Chairman Utect asked if there were any other questions, there were none. A motion was in order to adjoin. Marty Zernicke made the motion to adjourn, seconded by Duane Grunenwald.
Next meeting will be May 9, 2005 and the annual meeting will be Tuesday, April 12 at 7:30 p.m.
Mr. Zernicke made a motion to adjourn at 8:45 p.m., seconded by Mr.Grunenwald. Motion carried.

April 19, 2005
A Special Meeting of the Board of Supervisors for the Town of Maine was held at 8:00 a.m. Tuesday, April 19, 2005.
Agenda for this meeting was posted on April 14, 2005 at the Chapter Two Restaurant, Northside Citgo, Richard’s Supper Club, Schmidt’s Bar and the Town Hall.
Present were Chairperson, Betty Hoenisch, Clerk, Kimberly Freund, Supervisors, Dennis Wanke and Marty Zernicke, Town Workers , John Marquardt and Mike Wanke.
Chairperson Betty Hoenisch called the meeting to order at 8:03 a.m.
Chairperson Hoenisch handed out copies of the 2003 Paser Excel Spread sheet that list the ratings of the town roads. The chairperson Hoenisch handed out copies of the 2005 road budget and the roads that were proposed for 2005 projects. The Supervisors and town workers traveled all the roads that were rated 2 and 3 which are the worst town roads. After traveling and discussing possible solutions to some of the problem roads they returned to the town hall.
Mr. Zernicke made a motion to adjourn at 12:03 p.m., seconded by Dennis Wanke. Motion carried.

Chair Hoenisch called the meeting to order at 8:05 a.m.
Chair Hoenish stated that this portion of the meeting had been posted to address 2005 agenda and road items, however Supervisor Zernicke is on Jury Duty consequently some of these items will be postponed until he is in attendance.
Chair Hoenisch stated that she had met with Attorney Hess on Tuesday April 26, 2005. Attorney Hess suggested a policy with the City of Wausau regarding procedures for planning issues, such as the 20 th Avenue project and placing 28 th Avenue on the City of Wausau’s official map. Discussion followed regarding Brokaw and their water line, the LRIP Grant and also Chair Hoenisch reported on the road survey and 18 miles of bad roads rated 2 and 3 which are the most needy. There was additional discussion regarding Town zoning issues and Atty. Hess stated that the Town needs two sets of zoning, one for the north end and the sound end due to rural and suburban differences.
Chair Hoenisch announced that Marathon County and the DOT were going to allow the Town of Maine to substitute Naugart Drive and 60 th Avenue, both number 2 roads, for our LRIP Grant, since Brokow cannot fund their portion of 32 nd Avenue and Falcon Drive which was previously submitted and approved for the LRIP Grant.
Supervisor Wanke stated that the Town of Maine should meet with City of Wausau regarding Cassidy Drive and Overlook Drive for sharing the costs of repairing those roads. Supervisor Wanke also had stated that he met with Marathon County regarding the possibility of road wedging some roads in the Town. Clerk Freund had digital pictures of Falcon Drive, 32 nd Avenue and Decator Drive. There was additional discussion regarding some temporary fixes to some of our dangerous roads.
Attorney. Brunner arrived at 8:45.
Burnell Utecht and Dennis Wanke met to try to resolve the Wanke Matter. Bernelle came up with a possible solution that they will forward to Atty. Hess.
Burnell Utecht would like to know if he can get an extension otherwise he will need to get an attorney in regards to his case. Atty. Brunner said you can usually get extensions, but not indefinitely.
Chair Hoenisch gave Attorney Brunner a copy of Burnell Utecht’s suggestions.
April 28, 2005
The Board discussed Mr. Monk’s business subdivision located off of Cassidy Drive and questioned Attorney. Brunner regarding the status of Mr. Monk’s unwillingness to pay assessments for his portion of that road. Attorney. Brunner stated that all the other business owners are willing to pay their assessment and if Mr. Monk will not agree the Town will have to put a lien on his remaining vacant lots.
Chair Hoenisch welcomed the road bidders. In other business item A she announced that we would be awarding road bids.
The first road bid to be accepted was asphalt and pulverizing. American Asphalt bid $61,804.80 per 22 foot mile to an average depth of 2.5 inches and bid $7,744. 20 to pulverize a mile. Supervisor Wanke made a motion to accept American Asphalt’s bid, seconded by Chair Hoenisch. Motion carried.
Next, Chip seal bids were awarded. Fahrner Asphalt bid $10,122.00 per 22 foot mile. Scott Construction bid $9,695.00 per 22 foot mile. Supervisor Wanke made a motion to award Scott Construction, Inc., the Chip Seal bid. Chair Hoenisch seconded the motion. Motion carried.
Next, the only Slag sealing bidder was Fahrner Asphaft for $8,998.00 per 22 foot mile. Supervisor Wanke made a motion to award Fahrner Asphalt Sealers, Inc. any future jobs if we do any slag sealing in the Town of Maine. Chair Hoenisch seconded the motion. Motion carried.
Next, the Crack sealing bid was awarded. Bergman Companies, Inc., bid the crack sealing at $1.22 per pound with a five year warranty and Fahrner Asphalt bid at $1.02 per pound with a five year warranty. Supervisor Wanke made a motion to award Fahrner Asphalt Sealers, Inc. the crack seal bid. Chair Hoenisch seconded the motion. Motion carried.
Next, the Granite bids: There were three bids for Granite: Meverdon Materials, Inc., bid $5.48 per yard of screened granite. Red Rock Granite bid $5.84 per yard and Ladick Road Materials, Inc., bid $5.48 per yard. Supervisor Wanke made a motion to accept the bid from Ladick Road Materials, Inc. Chair Hoenisch seconded the motion. Motion carried.
Next, Crushed Road Base bids: Ladke Road Materials bid, $5.40 per ton and Anderson Brothers and Johson bid $5.30 per ton…both are from hard rock quarries. Supervisor Wanke made a motion to accept the bid from Anderson Brothers and Johnson. Chair Hoenisch seconded the motion. Motion carried.
Next, the Shouldering bid: One bid from Anderson Bros. and Johnson at $8.60 a ton to water, roll and compact road base shouldering material. Supervisor Wanke made a motion to accept their bid, Chair Hoenisch seconded the motion. Motion Carried.
The board will contact Gene Murrey from Scott Construction and Don Yaggie from Fahrner Asphalt Sealers to tour the roads soon and set up our crack sealing and chip sealing.
Item B: William and Vernelle Carazalla /Parkchester Subdivision have sold lot 3.
Per Atty. Brunner the Town needs to approve the zoning and building permits for that lot.
The Carazalla’s original agreement stated that the road would need to be paved first, however, the Town also needs to pave their portion of the subdivision roads and this is tentatively planned for 2006. The Town should require the Carazellas to put the road base down this year so it can settle for a year before paving. The town will prepare the ditches and shoulders this fall for the 2006 paving projects. Attorney Hess had recommended several times to have Quitclaim deeds to acquire additional land from property owners to allow for shouldering, ditching and widening of the road.
Supervisor Wanke made a motion to approve the permits for lot 3 in the Parkchester Subdivision.
Chair Hoenisch seconded the motion. Motion Carried.
Discussion followed by the board members about new subdivision roads that are damaged by excavators and Supervisor Wanke suggested possible notifying owners that they could be liable if their excavators damaged the roads. Marilyn Grunenwald questioned whether the paving of 32 nd Avenue and Falcon Drive was a verbal agreement because she felt Brokaw will continue to postpone the road project due to lack of funding. Public works employee, Mike Wanke, had suggested putting a lien on Brokaw’s lots to cover Brokaw’s portion. The board requested that Attorney Brunner research if this could be accomplished.
C. Lonsdorf road agreement. Atty. Brunner stated that George Lonsdorf sold some land to Mr. Forenza and the law firm drew up a road agreement with Mr. Lonsdorf. Chair Hoenisch stated that Mr. Forenza will be bringing a Preliminary subdivision plat map to the May plan commission meeting. Supervisor Wanke made a motion to approve the Lonsdorf agreement, Chair Hoenisch seconded the motion. Motion carried.
1. Discussion and possible action to approve the petition to amend the zoning ordinance to create a Historic Preservation Overlay District and rezone the property located at 5480 Hillcrest Drive . A special plan commission meeting and Public Hearing was held on April 18, 2005 to get surrounding land owners input or public input. The plan commission made a recommendation that the town board approve the zoning ordinance amendment to create this historical district and to rezone the property at 5480 Hillcrest Drive. It is beneficial to the town to preserve old buildings now and in the future and Attorney Brunner gave copies of the zoning amendment determination to the town board. This amendment is in two parts, one part is to create the historic district and the overlay district allows uses that would not normally occur in special areas in the town and it puts limitations on it because they have to stay historic.
The second part of the petition is for the 34-35 acres to be included in the historic preservation overlay district. The historic district would prevent the Town Hall from being remodeled to destroy the original state of the Town Building. A certificate of appropriateness is required with any change.
Questions followed regarding building and zoning permits for this property, Attorney Brunner stated that the town board can make recommendations to the planning committee. Supervisor Wanke made a motion to adopt the resolution approving the creation of a historical preservation district and to rezone the Dennis Griffen/ Willow Springs property located at 5480 Hillcrest Drive to that historically district. Clerk Hoenisch seconded the motion. Motion carried. Clerk, Kimberly Freund will submit the resolution to Marathon County for approval next week.
Item 4 was cancelled, the closed session due to Mr. Zernicke serving on jury duty.
Supervisor Wanke made a motion to adjourn, seconded by Chair Hoenisch.
Motion carried.
